Den rosa lagboken: Om särbehandling vid lagföring av kvinnor i organiserad brottslighet

Den organiserade brottsligheten i Sverige har radikalt ökat de senaste åren. Det förekommer debatter och förslag på hur man bäst ska få ordning på den ökade kriminaliteten och oron i samhället som har vuxit sig alltjämt starkare. En tanke som länge präglat straffrätten är att kvinnor inte begår brott i samma utsträckning som män. Huvudsakligen stämmer det, men statistiken talar för att kvinnors brottsliga aktivitet i kriminella nätverk ökar och blir alltjämt av mer allvarlig karaktär. De förekommer allt oftare i förundersökningar, men resultatet återspeglas inte i lagföringen.

Den organiserade brottsligheten i Sverige har radikalt ökat de senaste åren. Det förekommer debatter och förslag på hur man bäst ska få ordning på den ökade kriminaliteten och oron i samhället som har vuxit sig alltjämt starkare. En tanke som länge präglat straffrätten är att kvinnor inte begår brott i samma utsträckning som män. Huvudsakligen stämmer det, men statistiken talar för att kvinnors brottsliga aktivitet i kriminella nätverk ökar och blir alltjämt av mer allvarlig karaktär. De förekommer allt oftare i förundersökningar, men resultatet återspeglas inte i lagföringen.
I uppsatsen presenteras att det finns normer för hur män och kvinnor är eller hur de borde vara. Tankar om genus och kön karaktäriserar vad som benämns som normalt eller avvikande beteende. Forskning bekräftar att maskulinitet gäller som norm för brott och att våld är förknippat med maskulina egenskap-er. Män beskrivs som aktiva och starka, medan kvinnor beskrivs som passiva och svaga. Om man betraktar könen genom detta perspektiv döms man inte på samma premisser.
Uppsatsens syfte är, mot bakgrund av det ovan anförda, att utreda vilka före-ställningar om kvinnliga förövare som kan utläsas ur avgöranden från dom-stolar och vad det har för effekter på påföljdsbestämningen. I analysen presen-teras att rättsväsendet inte är isolerat från föreställningar om genus och kön, utan att de faller i samma fälla som resterande av samhället. Förutfattade me-ningar präglar sinnet omedvetet och konsekvenserna av det blir att kvinnor underskattas på grund av de egenskaper som tillskrivs dem. Den rosa lagbo-ken existerar och utgör ett verkligt problem som resulterar i att män och kvin-nor inte döms på samma premisser. (Less)

The organized crime in Sweden has radically increased over the past years. There have been debates and proposals on how to bring order to the increased crime and unrest in society. An idea that has long influenced society and criminal law is that women do not commit crimes to the same extent as men. Nor do they participate in criminal networks. There is truth to it, but statistics also suggest that women's criminal activity in criminal networks are increasing. Women are participating in serious variations of crime such as drugs and weapons. They appear more and more often in preliminary investigations, but the results are not reflected in prosecution decisions.

An idea that has long influenced society and criminal law is that women do not commit crimes to the same extent as men. Nor do they participate in criminal networks. There is truth to it, but statistics also suggest that women's criminal activity in criminal networks are increasing. Women are participating in serious variations of crime such as drugs and weapons. They appear more and more often in preliminary investigations, but the results are not reflected in prosecution decisions.

There are norms and notions for how men and women behave or should be-have. Thoughts about gender and sex characterize what is referred to as nor-mal or deviant behavior. Research confirms that masculinity applies as the norm for crime and that violence is associated with masculine characteristics. Men are described as active and strong, while women are described as passive and weak. If one views the genders through this perspective, there is a risk that they will not be judged on the same premises.

The purpose of the essay is to investigate which notions about female perpetrators can be deduced from court rulings and what effects this has had on the determination of punishment. In the analysis, it is presented that the judiciary is not isolated from notions of gender and sex, but that they fall into the same trap as the rest of society. Preconceived notions shape the mind unconsciously and the consequences are that women are undervalued because of the attributes attributed to them. There is a phenomenon known as the “pink law book” in the Swedish judiciary which leads to men and women being judged in different ways in criminal proceedings. (Less)
