Psykiskt störda lagöverträdares rättsliga ställning i Sverige och Danmark - Om ett återinförande av tillräknelighetskravet

En psykiskt störd lagöverträdare behöver i majoriteten av världens länder be-dömas vara tillräknelig för att kunna hållas straffrättsligt ansvarig för en brottslig gärning, det vill säga ha insikt och kontroll över sitt handlande vid gärningstillfället.
I Sverige avskaffades detta så kallade tillräknelighetskrav i samband med införandet av brottsbalken 1965. Idén bakom lagändringen byggde på föreställningen av att straff inte gynnade samhället. I stället skulle lagöverträdare med hjälp av vård och behandling vilja avstå från att falla tillbaka i kriminalitet och brottslighet. Ända sedan tillräknelighetskravet avskaffades har flera statliga offentliga utredningar och andra sakkunniga debatterat om att återinföra kravet.

I stället skulle lagöverträdare med hjälp av vård och behandling vilja avstå från att falla tillbaka i kriminalitet och brottslighet. Denna uppsats har två huvudsakliga syften. Dels att undersöka den svenska modellen i kontrast till Danmarks svar på tillräknelighetskravet, vilket är intressant med tanke på ländernas och rättsordningarnas likheter. Dels belysa den än pågående diskussionen om psykiskt störda lagöverträdares rättsliga ställning och föra fram för- och nackdelar med ett eventuellt återinförande i svensk rätt.
Uppsatsens slutdiskussion kommer fram till att ett tillräknelighetskrav likt Danmarks bör återinföras i svensk rätt. (Less)
Abstract
Most legal orders contain a requirement that a mentally disturbed offender must be considered sane in order to be held criminally responsible, in other words these offenders will only be imposed liability if they have had insight and control over their actions during the criminal act.
However, in Sweden, this exemption from criminal responsibility was abolished in conjunction with the passing of the Swedish criminal code in 1965. The idea behind the amendment of the law was based on the imagination that punishment was not beneficial for society. Most legal orders contain a requirement that a mentally disturbed offender must be considered sane in order to be held criminally responsible, in other words these offenders will only be imposed liability if they have had insight and control over their actions during the criminal act.
However, in Sweden, this exemption from criminal responsibility was abolished in conjunction with the passing of the Swedish criminal code in 1965. The idea behind the amendment of the law was based on the imagination that punishment was not beneficial for society. Instead, offenders were supposed to want to refrain from recidivism by receiving care and treatment. Ever since the exemption of mentally disrupted offenders being held criminally responsible was abolished, several government committees and other experts have discussed a possible reinforcement of the exemption.
This essay holds two main purposes. Partly to examine the Swedish model in contrast to the Danish take on the sanity requirement, which is interesting because of the close similarities between the countries and their legal systems. Partly to illustrate the still ongoing debate on mentally disturbed offenders’ legal status and present advantages and disadvantages with a possible reinforcement in Swedish law.
The end discussion of the essay reaches the conclusion that a reinforcement of the exemption of mentally disrupted offenders being held criminally responsible, like the one Denmark uses, is desirable. (Less)
