Verksamhet på liv och död: En uppsats om straffbarhet för legitimerad vårdpersonal

Till följd av principen om allas likhet inför lagen riskerar vårdpersonal allmänt åtal för misstag som föranlett att en allvarlig vårdskada har inträf-fat.
Även om antalet rättsfall inte är många syftar denna uppsats till att under-söka det straffrättsliga ansvar som föreligger för enskild vårdpersonal för misstag som sker i yrkesutövningen. Särskilt undersöks de faktorer som kan vara av betydelse för en friande respektive fällande dom, och huruvida nå-gon av dessa faktorer väger tyngre än någon annan.

Även om antalet rättsfall inte är många syftar denna uppsats till att under-söka det straffrättsliga ansvar som föreligger för enskild vårdpersonal för misstag som sker i yrkesutövningen. Särskilt undersöks de faktorer som kan vara av betydelse för en friande respektive fällande dom, och huruvida nå-gon av dessa faktorer väger tyngre än någon annan.
De faktorer som diskuteras i undersökta rättsfall är det personliga yrkesan-svaret som framkommer av 6 kap. 2 § patientsäkerhetslagen, patientens trygghet och förtroende till vården, arbetsbelastningen, vårdpersonalens erfarenhet, samt eventuella brister i vårdgivarens verksamhet.
Vid bedömningen av straffansvar saknas en enhetlig bild av hur faktorerna ska värderas. Domstolarna tar exempelvis endast i undantagsfall hänsyn till en hög arbetsbelastning och den stress som personalen upplever, i ett förmildrande hänseende. Personalens erfarenhet, och hur deras kunskap bör ha väglett dem i fallet, kan komma att vara en avgörande faktor, men till-räcklig empiri saknas med anledning av uppsatsens begränsade omfattning.
Det personliga ansvaret för misstag i yrkesutövningen har visat sig väga mycket tungt, särskilt då prejudicerade rättsfall bedömt hälso- och sjukvår-den som en högriskverksamhet som kräver särskild aktsamhet vid hand-lande. Uppsatsen avslutas därför med en analys gällande huruvida den stel-benta juridiska tillämpningen gör sig lämplig i en så pass riskfylld verk-samhet som vården utgör. (Less)

Due to the principle of equality before the law health care practitioners’ risk being subjected to public prosecution in general court because of a mistake made in their work.
Although the number of legal cases is low, this essay aims to examine criminal liability for health care practitioners for mistakes that occur during their professional practice. In particular, the factors that might be of im-portance for a verdict of acquittal or a verdict of guilty are examined, and weather any of those factors weigh more heavily than others.

Although the number of legal cases is low, this essay aims to examine criminal liability for health care practitioners for mistakes that occur during their professional practice. In particular, the factors that might be of im-portance for a verdict of acquittal or a verdict of guilty are examined, and weather any of those factors weigh more heavily than others.
The factors discussed in the presented legal cases are practitioners’ person-al liability, chapter 6 section 2 of the Patient Safety Act, the patient’s safety and trust for the health care system, the workload, the practitioners work experience, as well as any shortcomings in the health care system.
There is a lack of uniformity in the importance of the factors. Only in ex-ceptional cases will the courts take a high workload and the stress experi-enced by the practitioner into account as an extenuating circumstance. The practitioners work experience, and how their knowledge should affect their actions, might be a crucial factor, however there is not enough empirical evidence to form any conclusion due to the essays limited scope.
Health care practitioners’ personal liability have been shown to be a very important factor, especially since a precedent case judged health care as a high-risk function which demands special care from practitioners. The es-say will therefore analyze whether at rigid uniform application of the law is appropriate in health care. (Less)
