- Sverige är ett land med hög jämställdhet, men trots det finns det fortfarande brister inom
arbetslivet vad gäller oönskade beteenden på arbetsplatsen. Lagen och regleringen är utspridd
och inte helt enkel att förstå, vilket gör det svårt för arbetsgivare att aktivt arbeta för att
motverka oönskade beteenden. Vidare ser trakasserier och sexuella trakasserier olika ut i
olika branscher. Syftet med denna uppsats är att utreda om innehållet i lagen och regleringen
kring aktiva åtgärder för att motverka trakasserier och sexuella trakasserier är tillräckligt
tydliga för att kunna tillämpas i praktiken eller behöver utvecklas.

Vår utredning har visat att det finns en kunskapsbrist hos arbetsgivare gällande regleringen
kring aktiva åtgärder, trakasserier och sexuella trakasserier. Vi har sett att denna
kunskapslucka dels kan bero på att lagen är otydlig och alltför utspridd samt att det är svårt
att förstå skillnaden på DiskrL och AML. Det kan även vara företagskulturen som är
problemet vilket försvårar arbetet eftersom oönskade beteenden inte kan regleras bort i lag.
En diskussion förs även om möjligheter till förbättring, däribland genom regleringar i
kollektivavtal i form av branschanpassning, förtydligande av lagen samt fler rutiner och
riktlinjer för arbetsgivaren. (Less) - Abstract

The purpose of this essay is to investigate whether the content of the law and the regulations
regarding active measures to counter harassment and sexual harassment are clear enough to
be applied in practice or need to be developed.
Our research has shown that there is a lack of knowledge among employers regarding the
regulations surrounding active measures, harassment and sexual harassment. We have seen
that this knowledge gap can partly be due to the fact that the law is unclear and too spread out
and also that it is difficult to understand the difference between DiskrL and AML. It may also
be the company culture that is the problem, which makes the work regarding harassment
more difficult since unwanted behaviour cannot be regulated in law. A discussion is also held
about opportunities for improvement, including through regulations in collective agreements
in the form of industry adaptation, clarification of the law and more routines and guidelines
