Abstract
The employer's responsibility to rehabilitate is, in connection with an employee's reduced
ability to work as a result of illness, an obligation to investigate work adaptation and
rehabilitation possibilities to enable a return to work. The responsibility for rehabilitation is
mainly regulated within the Employment Protection Act (LAS), the work environment act
(AML), the social insurance code (SFB), and supplementary regulations (AFS). Parallel to the
employer's responsibility for rehabilitation in the event of sick leave, the Swedish Social
Insurance Agency (Försäkringskassan) is responsible for examining the right to sickness

The employer's responsibility to rehabilitate is, in connection with an employee's reduced
ability to work as a result of illness, an obligation to investigate work adaptation and
rehabilitation possibilities to enable a return to work. The responsibility for rehabilitation is
mainly regulated within the Employment Protection Act (LAS), the work environment act
(AML), the social insurance code (SFB), and supplementary regulations (AFS). Parallel to the
employer's responsibility for rehabilitation in the event of sick leave, the Swedish Social
Insurance Agency (Försäkringskassan) is responsible for examining the right to sickness
benefit. The Swedish Social Insurance Agency uses the chain of rehabilitation, a step-by-step
model regulated in SFB that tests the ability to work against different parts of the labour market,
to determine the right to sickness benefit. The purpose of the essay is to examine the employer's
responsibility to rehabilitate in contrast to the chain of rehabilitation. This is done by analyzing
similarities and differences between the processes and examining the collaborative work
between the employer and the Swedish Social Insurance Agency in the event of sick leave. The
conclusions that are drawn are that the collaborative work between the actors is lacking in both
design and execution, something that cost both the Swedish Social Insurance Agency and
employers money. Regarding similarities between the processes, it is concluded that the
Swedish Social Insurance Agency assesses the insured's ability to work on the same basis as
the employer exercises its rehabilitation responsibility up to day 180 of the sick leave, as well
as a closely related use of the term "rehabilitation" - a usage that is criticized. After 180 days
the assessment regarding work capacity starts to differ as the Swedish Social Insurance
Agency's assessment is extended to the entire labour market, while the employer continues to
only carry out rehabilitation work against their own workplace. In addition to this, we note that
the concept of relocation is used in different ways in the different processes. (Less)

Arbetsgivarens rehabiliteringsansvar innebär, i samband med att en arbetstagare får nedsatt
arbetsförmåga till följd av sjukdom, en skyldighet att utreda arbetsanpassnings- och
rehabiliteringsmöjligheterna för att möjliggöra återgång i arbete. Rehabiliteringsansvaret
regleras främst inom lagen om (1982:80) anställningsskydd, arbetsmiljölagen (1977:1160),
socialförsäkringsbalken (2010:110) och kompletterande föreskrifter. Parallellt med

likheter och skillnader mellan processerna samt undersöka samverkansarbetet mellan
arbetsgivaren och Försäkringskassan vid sjukskrivningar. Våra huvudsakliga slutsatser är att
samverkansarbetet mellan aktörerna brister i både utformning och utförande, något som kostar
såväl Försäkringskassan som arbetsgivare pengar. När det gäller likheter mellan processerna
konstaterar vi att Försäkringskassan bedömer den försäkrades arbetsförmåga på samma
grunder som arbetsgivaren utövar sitt rehabiliteringsansvar fram till sjukskrivningsdag 180
samt en närbesläktad användning av termen “rehabilitering” - en begreppsanvändning som
kritiseras. Efter 180 dagar skiljer sig däremot arbetsförmågebedömningen då
Försäkringskassans prövning vidgas mot hela arbetsmarknaden medan arbetsgivaren fortsatt
endast utför rehabiliteringsarbete mot den egna arbetsplatsen. Utöver detta konstaterar vi att
begreppet omplacering används på olika sätt i de skilda processerna (Less)
