Symbiosis of Labour and Competition Law - A closer look on what competition looks like for employees and self-employed.

Abstract
There are several ways of restricting competition, but there are regulations in national and EU- law which come into play when doing so. The purpose of this essay is to analyse the legal framework in Swedish national law concerning competition against an employer and examine the conditions under which an employee is allowed to compete against an employer. The essay will also take a look at how competition-clauses could infringe on EU-law. Additionally, the paper aims to clarify the relationship between self-employed and EU-competition law.

Moreover, when collectively bargaining, self-employed people are in most cases excluded from the EU-regulations which regulate anti-competitiveness between undertakings. There are however questions if there could be cases which fall outside of this exemption. (Less)

Det finns flera sätt att begränsa konkurrensen, men det finns bestämmelser i nationell och EU-rätt som spelar in när man gör det. Syftet med denna uppsats är att analysera den rättsliga ramen i svensk nationell rätt kring konkurrens mot en arbetsgivare och undersöka under vilka förutsättningar en anställd får konkurrera mot en arbetsgivare. Uppsatsen kommer också att ta en titt på hur konkurrensklausuler kan bryta mot EU-lagstiftningen. Dessutom syftar artikeln till att klargöra förhållandet mellan egenföretagare och EU:s konkurrenslagstiftning.

Vid kollektiva förhandlingar är egenföretagare dessutom i de flesta fall undantagna från EU-förordningarna som reglerar konkurrenshämmande åtgärder mellan företag. Det finns dock frågor om det kan finnas fall som faller utanför detta undantag. (Less)
