- The purpose of this study aims to execute and shed light on the legal devel-opment regarding the procedural edition's approval conditions in relation to the fishing expedition phenomenon.
In the field of civil procedure law, the parties are the main actors and the court's function is only to be a judicial body. The division of responsibilities is based on the idea of self-determination and personal integrity. This means that the information-poor party's right to information has to take a back seat in favor of the right of information holders to be left alone. The publishing insti-tute is an exception to this and is a way for a party to get help from the court with obtaining evidence. Despite the fact that the publishing institute is an... In the field of civil procedure law, the parties are the main actors and the court's function is only to be a judicial body. The division of responsibilities is based on the idea of self-determination and personal integrity. This means that the information-poor party's right to information has to take a back seat in favor of the right of information holders to be left alone. The publishing insti-tute is an exception to this and is a way for a party to get help from the court with obtaining evidence. Despite the fact that the publishing institute is an accepted exception, for a long time there has been a consensus around main-taining an obstacle to aimless and sweeping evidence research, so-called fish-ing expeditions.
What was previously firmly anchored and carved in stone has developed into a moving issue of protecting rights and integrity in the Swedish legal society. In modern times, the fishing expedition phenomenon tends to elude the law, but is as exciting a subject as it is snarky. (Less) - Abstract (Swedish)
