Sexsomni – att klandra eller inte klandra? En undersökning av förkastligheten i att utföra sexuella handlingar i sömnen

- Under de senaste åren har en ny invändning i våldtäktsmål uppkommit i de svenska domstolarna; sexsomniinvändningen. Med denna invändning påstår försvarssidan att den sexuella handlingen har begåtts i sömnen, vilket medför avsaknad av medvetenhet och uppsåt. I brottsbalken stadgas att om inget annat är föreskrivet är en gärning endast ett brott om den företas med uppsåt. Om åklagaren inte lyckas motbevisa sexsomniinvändningen friar domstolen således den tilltalade. Ett exempel på bevis som ofta anses styrka att den sexuella handlingen har utförts i sömnen är en tidigare historik av liknande beteende.

Rådande gällande rätt tillåter inte heller att förövaren döms för motsvarande sexuella handlingar som i stället förövas med oaktsamhet, då själva gärningen fortfarande behöver begås med uppsåt. Gärningsmannens eventuella vårdslöshet gäller endast rekvisitet att offret inte deltagit frivilligt i samlaget.
Att som huvudregel inte kunna dömas för sexuella handlingar som företas i sömnen medför dock inte nödvändigtvis att sådana handlingar inte är klandervärda. Klander implicerar således inte straff, men straff implicerar alltid klander. Syftet med uppsatsen är därför att undersöka om klandervärdheten i brotten våldtäkt och oaktsam våldtäkt är överförbar till motsvarande sexuella handlingar som företas i sömnen av personer med känd sexsomni. Med andra ord ska uppsatsen undersöka vad som gör våldtäkt och oaktsam våldtäkt klandervärt samt om dessa faktorer även stämmer överens med handlingar som företas under sexsomni.
Källorna som har använts i uppsatsen tyder på att klandervärdheten i våldtäkt och oaktsam våldtäkt är överförbar till motsvarande sexuella handlingar som begås i sömnen, förutsatt att personen har känd sexsomni. Fastän förkastliga handlingar som sagt inte behöver medföra straffansvar, uppmärksammar detta arbete så många likheter gällande klandervärdheten att det finns anledning att se över möjligheten till det. Granted that the prosecutor fails to refute this objection, the court thus acquits the defendant. An example of evidence that is regularly considered to strengthen the claim that the sexual act occurred while the perpetrator was asleep is a previous history of similar behavior.

Prevailing law does not either allow for the prospect of being sentenced for such sexual acts that are instead executed with neglect, since the deed itself still needs to be perpetrated with intent. Moreover, the potential negligence of the perpetrator only applies to the circumstance that the victim does not voluntarily participate in the intercourse.
However, the principal rule of not being held criminally responsible for sexual acts executed in sleep does not automatically imply that such actions are not reprehensible. In other words, blame does not entail punishment, but punishment always entails blame. Therefore, this essay aims to investigate if the culpability of rape and negligent rape is transferable to equivalent sexual acts that are committed during sleep, provided that the person is aware of their sexsomnia. An investigation will thus occur regarding what makes rape and negligent rape reprehensible and whether these factors are consistent with actions taken during sexsomnia or not.
The sources used in the essay indicate that the culpability of rape and negligent rape is transferable to sexual acts committed in sleep when the person has known sexsomnia. Although reprehensible actions, as previously mentioned, do not necessarily entail criminal liability, this essay displays so many similarities regarding the reprehensibility that there is reason to review the possibility of it.
