Är gräset grönare på andra sidan bron? – En komparativ analys av Sveriges nämndemannasystem och Danmarks system med nævninger och domsmænd

I kölvattnet av den omtalade ”snippadomen” har debatten om det svenska nämndemannasystemet väckts på nytt våren 2023. Debatten uppmärksammar dels problematiken kring de politiska partiernas nära inblandning med rekryteringen av nämndemän, dels huruvida nämndemannasystemet som det ser ut idag är motiverat. Flera politiska partier har uttryckt en önskan att reformera systemet utan att ge exempel på hur. I Danmark är lekmannasystemet vid en första anblick annorlunda utformat. Därtill har systemet enbart funnits i cirka 100 år. Det är därmed betydligt nyare än Sveriges system, vars anor går 800 år tillbaka i tiden. Med utgångspunkt i detta ställer uppsatsen frågan om det finns något att lära från det danska systemet.

Flera politiska partier har uttryckt en önskan att reformera systemet utan att ge exempel på hur. I Danmark är lekmannasystemet vid en första anblick annorlunda utformat. Därtill har systemet enbart funnits i cirka 100 år. Det är därmed betydligt nyare än Sveriges system, vars anor går 800 år tillbaka i tiden. Med utgångspunkt i detta ställer uppsatsen frågan om det finns något att lära från det danska systemet.

Syftet med uppsatsen är att undersöka det svenska nämndemannasystemet och dess eventuella förbättringsmöjligheter. Genom att studera båda länders lekmannasystem, utreds först likheterna och skillnaderna. Därefter resoneras kring fördelar och nackdelar med respektive system för kunna ge ytterligare underlag vid besvarandet av den slutliga frågan – finns det ett reformbehov i Sverige och hur skulle en sådan reform kunna se ut?

Uppsatsens frågeställningar besvaras därmed genom applicerandet av en komparativ metod för att skapa en ökad förståelse för den inhemska lagstiftningens utformning, samtidigt som det öppnar upp möjligheten att utforska ett annat lands lösning på liknande problem. Därtill används även en rättsdogmatisk och rättsanalytisk metod.

Uppsatsen förhåller sig kritisk till huruvida det svenska systemet verkligen uppnår sitt tänkta syfte. En av de främsta motiveringarna till nämndemannasystemet är att skapa förtroende för de svenska domstolarna. Utifrån vad som presenteras i uppsatsen ställs frågan om det snarare är så att dagens nämndemannasystem gör motsatsen. Det konstateras att Danmarks system med nævninger och domsmænd verkar fungera mer ändamålsenligt. Därtill finner uppsatsen att det finns inspiration att hämta från Danmark särskilt i hänseendet att skapa en lekmannakår som är representativ för befolkningen. Slutsatsen blir att en ny utredning av nämndemannasystemet vore på sin plats. (Less)

In the wake of a highly controversial appellate court verdict from February 2023, the debate about the Swedish lay judge system has been revived. The debate highlights both the problems surrounding the political parties’ close involvement in the recruitment of lay judges as well as whether the current lay judge system is justified. Several political parties have expressed a desire to reform the system without providing examples of how. At first glance, the lay judge system in Denmark appears to be different from the Swedish. Additionally, the system has only existed for about 100 years. Therefore, it is considerably newer than the Swedish system, which has roots dating back 800 years. The debate highlights both the problems surrounding the political parties’ close involvement in the recruitment of lay judges as well as whether the current lay judge system is justified. Several political parties have expressed a desire to reform the system without providing examples of how. At first glance, the lay judge system in Denmark appears to be different from the Swedish. Additionally, the system has only existed for about 100 years. Therefore, it is considerably newer than the Swedish system, which has roots dating back 800 years. Based on this, the essay raises the question of whether there is anything to learn from the Danish system.

The purpose of the essay is to examine the Swedish lay judge system and its potential for improvement. By studying the lay judge systems in both countries, the similarities and differences are investigated. The essay then proceeds to discuss the advantages and disadvantages of each system, in order to provide further basis when answering the final question: Is there a need for reform in Sweden, and what could such a reform look like?

The essay’s research questions are therefore answered through the application of a comparative method, aiming to enhance understanding of the domestic legislation’s structure while also exploring another country’s approach to similar issues. In addition, a legal doctrinal and legal analytical method are used.

The essay takes a critical stance on whether the Swedish system truly achieves its intended purpose. One of the primary justifications for the lay judge system is to build trust for the Swedish courts. Based on the arguments presented in the essay, the question is raised whether the current lay judge system instead undermines this purpose. It is concluded that Denmark’s system with nævninger and domsmænd appears to fulfill its purpose better. Furthermore, the essay finds that there is inspiration to be drawn from Denmark, particularly in terms of creating a lay judge corps that is representative of the population. Finally, the essay reaches the conclusion that a new investigation regarding the lay judge system would be appropriate. (Less)
