Abstract (Swedish)
Omskärelsen som företeelse har sina rötter årtusenden tillbaka i tiden och genomförs runt om i världen av olika skäl. Den religiöst motiverade omskärelsen på minderåriga pojkar är tillåten i Sverige genom lag (2001:499) om omskärelse av pojkar (OmskL). Lagens utformning underbyggs av argument avseende religionsfrihet och vårdnadshavarens rätt att uppfostra sina barn i enlighet med deras religiösa övertygelse. Bedömningen av vad som är barnets bästa anses enligt förarbetena vara att ingreppet sker under trygga och säkra förhållanden.

Den religiöst motiverade omskärelsen på minderåriga pojkar är tillåten i Sverige genom lag (2001:499) om omskärelse av pojkar (OmskL). Lagens utformning underbyggs av argument avseende religionsfrihet och vårdnadshavarens rätt att uppfostra sina barn i enlighet med deras religiösa övertygelse. Bedömningen av vad som är barnets bästa anses enligt förarbetena vara att ingreppet sker under trygga och säkra förhållanden.
Tanken med uppsatsen har varit att ställa dessa argument emot barnets rättigheter, problematisera barnets bästa och göra en jämförelse med regleringen av kvinnlig könsstympning. Arbetet har ämnat att utreda frågan ur ett kritiskt perspektiv med fokus på barnens rätt.
Det har framkommit att man i förarbetena till OmskL intar ett föräldraperspektiv i avvägningen mellan religionsfriheten och barnets rättigheter. Likaså i bedömningen av vad som är barnets bästa. Det har skildrats en avvikande bedömning i frågan om kvinnlig könsstympning (som är förbjuden i alla former) där man till skillnad från i OmskL intar barnets perspektiv.
Uppsatsens slutsats är att lagens nuvarande utformning genom OmskL är bristfällig sett till ett beaktande av barnets rättigheter. (Less)

The phenomenon of circumcision dates thousands years back and is performed all around the world for various reasons. The religiously motivated circumcision of underage boys has been permitted in Sweden under the law on circumcision of boys from 2001. The formulation of the law is underpinned by arguments relating to religious freedom and the right of custodians to raise their children in accordance with their religious beliefs. The assessment of what is the best interest of the child is considered, according to the preparatory works, to be that the intervention takes place under safe and secure conditions.

The phenomenon of circumcision dates thousands years back and is performed all around the world for various reasons. The religiously motivated circumcision of underage boys has been permitted in Sweden under the law on circumcision of boys from 2001. The formulation of the law is underpinned by arguments relating to religious freedom and the right of custodians to raise their children in accordance with their religious beliefs. The assessment of what is the best interest of the child is considered, according to the preparatory works, to be that the intervention takes place under safe and secure conditions.
The idea of the essay has been to set these arguments against the rights of the child, to problematize the best interest of the child and further to make a comparison with the regulation of the female genital mutilation. The work has aimed to investigate the issue from a critical perspective with focus on children’s rights.
It has emerged that the preparatory work for the law on circumcision of boys adopts a parental perspective in the consideration between the religious freedom and the rights of the child. Likewise in the assessment of what is the best interests of the child. A different assessment has been described in the issue of female genital mutilation (which is forbidden in all forms) where the child’s perspective is considered.
The conclusion has been that the current design of the law on circumcision of boys is inadequate from a child rights perspective. (Less)
