Barnets bästa och barns rätt att komma till tals i LVU-mål - En undersökning av domstolars praktiska tillämpning av barnkonventionen

Den 1 januari 2020 blev FN:s konvention om barnets rättigheter svensk lag, vilket ytterligare skulle stärka barnets rättigheter. Före inkorporeringen hade det bland annat påtalats brister när det gällde genomslaget för barns rättigheter enligt konventionen i Sverige. Uppsatsens övergripande syfte är att undersöka om barns rättigheter enligt barnkonventionen, med särskilt fokus på artiklarna barnets bästa och barnets rätt att komma till tals, kan anses ha stärkts sedan inkorporeringen av konventionen i svensk lag i mål rörande tvångsvård enligt lagen (1990:52) med särskilda bestämmelser om vård av unga (LVU).

Den 1 januari 2020 blev FN:s konvention om barnets rättigheter svensk lag, vilket ytterligare skulle stärka barnets rättigheter. Före inkorporeringen hade det bland annat påtalats brister när det gällde genomslaget för barns rättigheter enligt konventionen i Sverige. Uppsatsens övergripande syfte är att undersöka om barns rättigheter enligt barnkonventionen, med särskilt fokus på artiklarna barnets bästa och barnets rätt att komma till tals, kan anses ha stärkts sedan inkorporeringen av konventionen i svensk lag i mål rörande tvångsvård enligt lagen (1990:52) med särskilda bestämmelser om vård av unga (LVU).

I uppsatsen används primärt den rättsdogmatiska metoden genom att studera de allmänt accepterade rättskällorna, nämligen lagtext, förarbeten, rättspraxis samt doktrin, medan den rättsanalytiska metoden, som är mer öppen för att ge utrymme åt bland annat kritisk analys, används för uppsatsens analytiska avsnitt. Uppsatsen ger inledningsvis en beskrivning av barnkonventionens historiska bakgrund och tillhörande relevanta artiklar, samt vägen till konventionens inkorporering i svensk rätt. Därefter redogörs för gällande rätt med fokus på principen om barnets bästa och barnets rätt att komma till tals. Fokus flyttas sedan vidare till att behandla rättsfall rörande LVU från tiden före och efter inkorporeringen av barnkonventionen. Avsikten är att försöka utreda om det har skett någon förändring avseende hur barnets bästa och barnets rätt att komma till tals beaktas i den praktiska tillämpningen.

I de LVU-mål som har varit föremål för granskning kan överlag ses, något mer efter än före införlivandet, att domstolarna redovisar barnets inställning och åsikter, om de fått komma till tals, samt gör en ganska så utförlig bedömning av vad som är barnets bästa i det specifika fallet. Det kan självfallet diskuteras huruvida denna skillnad beror på implementeringen av barnkonventionen, men möjligen hade detta kunnat tala för att barns rättigheter i viss mån har stärkts sedan inkorporeringen. Dessutom visar undersökningen av de olika rättsfallen att det, i det stora hela, finns en medvetenhet om FN:s konvention om barnets rättigheter inom det svenska domstolsväsendet, men att det finns utrymme för ökad kunskap om barnets rättigheter. On the 1st of January 2020, the UN Convention on the Rights of the Child was incorporated into Swedish law to further strengthen the rights of the child. Prior to the incorporation, deficiencies had been pointed out when it came to the impact of children's rights according to the Child Convention in Sweden. Prior to the incorporation, deficiencies had been pointed out when it came to the impact of children's rights according to the Child Convention in Sweden. The overall purpose of the thesis is to investigate whether children's rights according to the UN Convention on the Rights of the Child, with particular focus on article 3 and article 12, can be considered to have been strengthened since the incorporation in cases concerning compulsory care according to the Care of Young Persons (Special Provisions) Act (1990:52) (LVU). Article 3 is about the best interests of the child and article 12 is about every child's right to express their view, and about adults' obligation to listen to the child.

In the essay, the legal dogmatic method is primarily used by studying the generally accepted sources of law, namely legal text, preparatory works, legal cases and doctrine, while the legal analytical method is used for the analytical section of the essay. The essay initially provides a description of the historical background of the UN Convention on the Rights of the Child and associated relevant articles, as well as the path to the Convention's incorporation into Swedish law. Then the applicable law is explained with a focus on the principle of the child's best interest and the child's right to be heard. The focus then moves on to deal with legal cases concerning LVU from the time before and after the incorporation of the Child Convention. The intention is to try to investigate whether there has been any change regarding article 3 and article 12 in the practical application.

In the cases concerning compulsory care according to LVU it can generally be seen, slightly more after than before the incorporation, that the courts report the views of the child and make a rather detailed assessment of what are the best interests of the child in the specific case. It can be discussed whether this difference is due to the implementation of the Child Convention, but this could possibly mean that children's rights have been strengthened to a certain extent since incorporation. In addition, the examination of the various legal cases shows that, on the whole, there is an awareness of the UN Convention on the Rights of the Child within the Swedish court system, but that there is room for increased knowledge about the rights of the child.
