Samboskap i förändring - Jämförelse mellan samboskap i arvsrätten och socialförsäkringsrätten

Synen på förhållanden utanför äktenskapet har förändrats under historiens gång och antalet samboförhållanden har ökat kraftigt. Detta har lett till införandet av en lagstiftning som reglerar samboskapet. Allteftersom tiden gått har samhället fortsatt att förändras, men lagarna som reglerar sambo-skapet har inte gjort det. Dessa har i stället föråldrats.
Sambor ärver inte varandra enlig svensk lag. De jämställs inte med makar i fråga om arvsrätt och vid den ena partnerns bortgång har den efterlevande partnern endast rätt till hälften av den gemensamma bostaden och det bo-hag som förvärvats för gemensamt bruk om de efterlevande begär bodel-ning. De jämställs inte med makar i fråga om arvsrätt och vid den ena partnerns bortgång har den efterlevande partnern endast rätt till hälften av den gemensamma bostaden och det bo-hag som förvärvats för gemensamt bruk om de efterlevande begär bodel-ning. Det troligtvis mest uppmärksammade sådana fallet gäller författaren Stieg Larssons bortgång och hans arvlösa, efterlevande sambos förlorade kamp för allt som paret skapat tillsammans under sin mångåriga sambore-lation.
För studien om synen på samboskap inom socialförsäkringsrätten valdes bostadsbidrag, bostadstillägg och äldreförsörjningsstöd som studieobjekt. Det framkom att inom socialförsäkringsrätten jämställs sambor med makar och deras ekonomi sammanräknas vid bedömning av ansökan om ekono-miskt bidrag trots att sambor inte är underhållsskyldiga för varandra.
Syftet med denna framställning är att analysera synen på samboskap inom arvsrätten i jämförelse med syn på samboskap i socialförsäkringsrätten, att jämföra olika tolkningar av begreppet sambo i dessa två rättsområden vid tillämning av lagstiftningen. (Less)

The perception of relationships outside of marriage has changed over time and the amount of relationships between unmarried partners has increased. This has led to the introduction of a legislation that regulates cohabitation. Time has passed and society has therefore continued to progress and evolve, but the laws that regulate cohabitation have failed to do the same. They have become outdated.
Cohabitants do not inherit from each other under Swedish law. They are not equated with married spouses concerning inheritance rights, and if a partner passes away, the living partner is only entitled to half of the jointly owned home and household goods intended for shared use if the division of property is requested. The perception of relationships outside of marriage has changed over time and the amount of relationships between unmarried partners has increased. This has led to the introduction of a legislation that regulates cohabitation. Time has passed and society has therefore continued to progress and evolve, but the laws that regulate cohabitation have failed to do the same. They have become outdated.
Cohabitants do not inherit from each other under Swedish law. They are not equated with married spouses concerning inheritance rights, and if a partner passes away, the living partner is only entitled to half of the jointly owned home and household goods intended for shared use if the division of property is requested. Perhaps the most notable case is after the passing of the author Steig Larsson, where his living cohabiting partner lost the legal battle for everything the couple had created during their long relationship together.
For the study of cohabitation according to the social security law they chose, housing allowance, housing supplement and elderly care as the ob-jects of study. It became apparent that within the social security law, co-habitants and spouses are equated, and their finances are combined when assessing an application for financial assistance, even though cohabitants are not required to financially support one another.
The purpose of this presentation is to analyse the view of cohabitation in the laws of inheritance, versus the law of social security, and to compare different interpretations of the term ‘cohabitation’ in these two areas of law when applying legislations. (Less)
