Inkorporering av barnkonventionen har länge varit ett omdebatterat ämne både nationellt och internationellt, särskilt i Sverige och Danmark. I Sverige resulte-rade den långvariga debatten i att barnkonventionen trädde i kraft som svensk lag år 2020, medan Danmark än så länge har avstått från att inkorporera kon-ventionen. Syftet med uppsatsens är att belysa de argument som har framförts av respektive land angående en inkorporering av barnkonventionen. Syftet är även att identifiera och jämföra likheter och skillnader i argumentationen mellan de båda länderna samt undersöka varför länderna har valt olika tillvägagångssätt vad gäller inkorporering av barnkonventionen. Inkorporering av barnkonventionen har länge varit ett omdebatterat ämne både nationellt och internationellt, särskilt i Sverige och Danmark. I Sverige resulte-rade den långvariga debatten i att barnkonventionen trädde i kraft som svensk lag år 2020, medan Danmark än så länge har avstått från att inkorporera kon-ventionen. Syftet med uppsatsens är att belysa de argument som har framförts av respektive land angående en inkorporering av barnkonventionen. Syftet är även att identifiera och jämföra likheter och skillnader i argumentationen mellan de båda länderna samt undersöka varför länderna har valt olika tillvägagångssätt vad gäller inkorporering av barnkonventionen. I uppsatsen lyfts Europakonventionen fram som ett exempel till jämförelse, då det är den enda människorättskonvention som både Sverige och Danmark tidigare har inkorporerat.

Uppsatsen diskuterar även skillnaden mellan monistiska och dualistiska stater samt redogör för vilka metoder som används för att införliva internationella konventioner i nationell rätt. Här utreds skillnaderna mellan konstaterande av normharmoni, transformering och inkorporering. Både Sverige och Danmark är dualistiska stater som har uträttat tolkningsprinciper som påverkar hur nationell rätt tolkas i ljuset av folkrätten. Uppsatsen fastställer även att staterna har en tradition av transformering och konstaterande av normharmoni vad gäller människorättskonventioner.

Uppsatsen utmynnar i att det inte finns några väsentliga skillnader i argumenten för och emot inkorporeringen av barnkonventionen mellan Sverige och Danmark. De främsta argumenten för inkorporering i båda länderna är att stärka barns rättigheter och sända en politisk signal till omvärlden. Det främsta motargumentet är risken för maktförskjutning från lagstiftande makten till domstolar och andra rättstillämpande myndigheter. Anledningen till att Sverige har valt att inkorporera konventionen medan Danmark har avstått kan förklaras av politiska överväganden, vikten som tillmäts enskilda argument samt ländernas tradition och syn på internationella konventioner. The incorporation of the Convention on the Rights of the Child has been a long-debated issue both nationally and internationally, in Sweden and Den-mark. In Sweden, the prolonged debate resulted in the Convention being enacted as Swedish law in 2020, whereas Denmark has thus far refrained from incorporating the Convention. The purpose of this essay is to elucidate the arguments put forth by each country regarding the incorporation of the Convention. Furthermore, the aim is to identify and compare the similarities and differences in argumentation between the two countries, as well as to investi-gate why they have chosen different approaches to the incorporation of the Convention. The incorporation of the Convention on the Rights of the Child has been a long-debated issue both nationally and internationally, in Sweden and Den-mark. In Sweden, the prolonged debate resulted in the Convention being enacted as Swedish law in 2020, whereas Denmark has thus far refrained from incorporating the Convention. The purpose of this essay is to elucidate the arguments put forth by each country regarding the incorporation of the Convention. Furthermore, the aim is to identify and compare the similarities and differences in argumentation between the two countries, as well as to investi-gate why they have chosen different approaches to the incorporation of the Convention. The essay highlights the European Convention as an example, as it is the only human rights convention previously incorporated by both Sweden and Denmark.

The essay also discusses the distinction between monist and dualist states and provides an account of the methods used to incorporate international conven-tions into national law. In the discussion, the differences between the establishment of norm harmony, transformation, and incorporation are examined. Both Sweden and Denmark are dualist states that have adopted interpretive principles that influence the interpretation of national law in light of international law. The essay also establishes that the states have a tradition of transformation and the establishment of norm harmony concerning human rights conventions.

Ultimately, the essay concludes that there are no significant differences in the arguments for and against the incorporation of the Convention on the Rights of the Child between Sweden and Denmark. The primary arguments for in-corporation in both countries are to strengthen children's rights and make a political statement towards the international community. The main counterar-gument is the risk of a shift in power from the legislative authority to the judi-ciary and other law enforcement authorities. The reason for Sweden's decision to incorporate the Convention and Denmark’s non-incorporation can be explained by political considerations, the significance attributed to individual arguments, as well as the countries' traditions and perspectives on international conventions.
