Rättssäkerhetsbegreppet i samtidsdebatten - en analys utifrån exempel

- Begreppet rättssäkerhet används ofta både inom och utom den rättsvetenskapliga sfären. Eftersom man inte sällan möter det i den allmänna debatten i Sverige, syftar den här uppsatsen till att undersöka om begreppet i det sammanhanget används i samma betydelse som inom rättsvetenskapen.
Undersökningen tar avstamp i vad framstående svenska rättsvetare har uttryckt ifråga om att definiera begreppet rättssäkerhet under de senaste decennierna. En sammanställning av detta presenteras tillsammans med en kort genomgång av vad som sägs om rättssäkerhet i svensk lag.
Med detta material som bakgrund går uppsatsen vidare till att analysera ett exempel ur den svenska rättspolitiska debatten - vilket utgörs av en debattartikel som publicerats med... Med detta material som bakgrund går uppsatsen vidare till att analysera ett exempel ur den svenska rättspolitiska debatten - vilket utgörs av en debattartikel som publicerats med anledning av en uppmärksammad dom under första halvan av år 2023 – för att jämföra dess användning av rättssäkerhetsbegreppet med rättsvetenskapens.
Uppsatsens slutsats landar i att det kan finnas fog för uppfattningen att rättssäkerhetsbegreppet bär en annan betydelse i dagligt tal än vad det gör inom rättsvetenskapen, men att ytterligare utredning skulle krävas för att detta skulle kunna sägas med större säkerhet. (Less) - Abstract
- The Swedish equivalent of the term “the rule of law”, namely “rättssäkerhet”, is widely used both within and outside of the sphere of legal research. Since it is often seen in the Swedish public debate, this essay aims to examine whether the term is used in the same denotation in this context, as it is within the context of legal studies.
This examination starts off by compiling and collating what has been expressed on the question of the definition of the term “rättssäkerhet” by prominent, Swedish legal scholars over the last decades. This is presented together with a short review of what Swedish law says about the term.
Based on this material, the essay then goes on to examine an example from the Swedish legal political debate –... (More) - The Swedish equivalent of the term “the rule of law”, namely “rättssäkerhet”, is widely used both within and outside of the sphere of legal research. Since it is often seen in the Swedish public debate, this essay aims to examine whether the term is used in the same denotation in this context, as it is within the context of legal studies.
This examination starts off by compiling and collating what has been expressed on the question of the definition of the term “rättssäkerhet” by prominent, Swedish legal scholars over the last decades. This is presented together with a short review of what Swedish law says about the term.
Based on this material, the essay then goes on to examine an example from the Swedish legal political debate – made up of an opinion piece published in the wake of a court ruling that garnered much attention during the first half of the year 2023 – to compare its use of the term “rättssäkerhet” with that of the legal scholars.
The essay concludes that there is an indication that there might be a discrepancy between the meaning the term “rättssäkerhet” bears in every-day speech and the meaning it bears within the field of legal studies, but that further research is needed for this to be confidently ascertained. (Less)
