Under de senaste åren har straffrättsliga åtgärder för att komma till bukt med så kallad gängkriminalitet blivit särskilt populärt. I rättspolitiken har frågan om kriminalitet fått en särskild stor plats. Många förslag har lagts fram som kän-netecknas av hårdare tag. Ett av förslagen har varit att kriminalisera deltagande i kriminella gäng. Det är som uppsatsen fokuserar på.
Förslaget att kriminalisera deltagande av kriminella gäng är hittills endast ett kriminalpolitiskt sådant. Det har således inte lett till offentliga utredningar eller propositioner. I rättspolitiken har frågan om kriminalitet fått en särskild stor plats. Många förslag har lagts fram som kän-netecknas av hårdare tag. Ett av förslagen har varit att kriminalisera deltagande i kriminella gäng. Det är som uppsatsen fokuserar på.
Förslaget att kriminalisera deltagande av kriminella gäng är hittills endast ett kriminalpolitiskt sådant. Det har således inte lett till offentliga utredningar eller propositioner. På grund av förslagets popularitet har det dock ändå valts att utreda. Uppsatsen syftar således till att utreda huruvida en kriminalisering av deltagande i kriminella gäng kan utgöra en godtagbar kriminalisering. För utredningen har kriminaliseringsprinciper som tar sikte på både när och hur en kriminalisering ska ske för att vara godtagbar beaktats. Principen om ultima ratio, godtagbart skyddsintresse, effektivitetsprincipen samt förutsebarhets-kravet ställer upp krav på en kriminaliserings utformning och eventuella nöd-vändighet. Dessa är högst aktuella vid frågan om det aktuella deltagandebrot-tet. I år träder vidare en lag i kraft som kriminaliserar deltagande i terroristor-ganisationer. Uppsatsen följer och redogör för utvecklingen av det brottets införande. Vad som kan utrönas ur den utvecklingen är att ett deltagandebrott innebär en begränsning av den grundlagsskyddade föreningsfriheten. En änd-ring i grundlagen måste således ske innan ett deltagandebrott kan införas.
Efter beaktande av detta går uppsatsen vidare med att diskutera de straffrätts-liga aspekterna och kraven för en godtagbar kriminalisering. Resultat visar att ett deltagandebrott för kriminella gäng möter en del hinder. Det största hindret anses vara att kriminella gäng saknar en vedertagen definition. Av alla krimi-naliseringsprinciper som behandlas stämmer ter sig enbart principen om god-tagbart skyddsintresse överens med förutsättningarna för en godtagbar krimi-nalisering. (Less)

In recent years, criminal justice measures to deal with so-called gang crime
have become particularly popular. Many proposals have been put forward that
are characterized as being tough on crime. One of the proposals has been to
criminalize the participation in so-called criminal gangs. It is this proposal
that this bachelor’s thesis focuses on. The proposal to criminalize the participation of criminal gangs is so far only
a political one. It has not led to any official governmental reports or an actual

In recent years, criminal justice measures to deal with so-called gang crime

are characterized as being tough on crime. One of the proposals has been to
criminalize the participation in so-called criminal gangs. It is this proposal
that this bachelor’s thesis focuses on. The proposal to criminalize the participation of criminal gangs is so far only
a political one. It has not led to any official governmental reports or an actual
bill. Due to the popularity of the proposal, however, it has been chosen to
examine in this thesis. The thesis therefore aims to examine whether a criminalization of participation in criminal gangs is acceptable. Principles of criminalization that focus on when and how a criminalization is to be regarded as acceptable have been chosen to do so. The principle of ultima ratio, acceptable protective interest, the efficacy principle, and the requirement of foreseeability set requirements for how a criminalization is to be formulated and whether it is necessary. These principles are highly relevant when it comes to the proposal to criminalize participation in criminal gangs. This year, a law criminalizing the participation in terrorist organizations comes into force. This thesis follows and explains the development of this crime. What can be ascertained from the development is that a participation offense implies a limitation of the constitutionally protected freedom of association. An amendment to the constitution must therefore take place before a
crime of participation can come into force. After taking this to account, this thesis goes on to discuss the criminal law aspects and the requirements for an acceptable criminalization. The results show that a participation crime for criminal gangs face some obstacles. The biggest obstacle is seems to be the lack of an established definition for criminal gangs. Of all the criminalization principles discussed, only the principle of acceptable protective interest is somewhat consistent with the requirements for an acceptable criminalization. (Less)
