Kriminalpolitiken har under senare år riktat allt större fokus mot straffskärpningar. I media presenteras ofta en bild av att kriminaliteten ökat och blivit allt grövre. Av denna anledningen blir responsen att öka straffen med syftet att minska kriminaliteten. Under de senaste två åren har lagförslag tagits fram med fokus på flerfaldig brottslighet och återfall. Dessa lagförslag tar sikte på brottsaktiva individer och syftet med förslagen är att påföljderna ska bli mer rättvisa.

Kriminalpolitiken har under senare år riktat allt större fokus mot straffskärpningar. I media presenteras ofta en bild av att kriminaliteten ökat och blivit allt grövre. Av denna anledningen blir responsen att öka straffen med syftet att minska kriminaliteten. Under de senaste två åren har lagförslag tagits fram med fokus på flerfaldig brottslighet och återfall. Dessa lagförslag tar sikte på brottsaktiva individer och syftet med förslagen är att påföljderna ska bli mer rättvisa.

Syftet med uppsatsen är att  granska den föreslagna lagändringen gällande flerfaldig brottslighet samt tidigare lagförslag gällande återfall, med utgångspunkt i ett rättviseperspektiv. Särskilt fokus läggs på lagförslagens förhållande till asperationsprincipen, proportionalitetsprincipen och ett antal vedertagna bestraffningsteorier. Dessa är allmänprevention, individualprevention, humanitet och vedergällning. Vidare avser arbetet att studera vilka de främsta konsekvenserna av dessa lagförslag är, både ur ett straffrättsligt och ekonomiskt perspektiv. 

Arbetets slutsats är att båda lagförslagen i viss mån strider mot teorin om humanitet. Däremot är båda förslagen till stor del förenliga med proportionalitetsprincipen samt teorierna om allmänprevention, individualprevention och vedergällning. Förslaget om straffskärpning vid flerfaldig brottslighet är vidare förenlig med asperationsprincipen. Konsekvenserna av en implementering av dessa lagförslag blir att domstolarna behöver omarbeta metoden för beräkning av det samlade straffvärdet vid flerfaldig brottslighet. Vidare kommer sättet att bestämma påföljd vid återfall i brott att förändras, eftersom återfallet förväntas göra ett större avtryck vid påföljdsbestämningen. Utöver de konsekvenser som förslagen får för straffmätningen och påföljdsbestämningen, kommer de även att resultera i stora ekonomiska konsekvenser för både de utredande och verkställande myndigheterna. The public interest for Criminal law has spiked in recent years, especially with a focus on tougher penalties. The media often sends the message that crime has increased and become more violent. The response seems to be a desire to increase punishment in hopes of reducing crime. Over the past two years, bills have been drafted focusing on repeat offending and recidivism. These legislative proposals are aimed at criminally active individuals and the purpose of the proposals is to make the penalties more fair.

The public interest for Criminal law has spiked in recent years, especially with a focus on tougher penalties. The media often sends the message that crime has increased and become more violent. The response seems to be a desire to increase punishment in hopes of reducing crime. Over the past two years, bills have been drafted focusing on repeat offending and recidivism. These legislative proposals are aimed at criminally active individuals and the purpose of the proposals is to make the penalties more fair.

The purpose of the essay is to review the proposed legislative amendment regarding multiple criminality as well as previous legislative proposals regarding recidivism, based on a justice perspective. Special focus is placed on the bill's relationship to the asperation principle, the proportionality principle and a number of accepted punishment theories. These are general prevention, individual prevention, humanity and retribution. Furthermore, the work intends to study what the main consequences of these bills are, both from a criminal law and economic perspective.

The conclusion of the work is that both bills are to some extent contrary to the theory of humanity. However, both proposals are largely compatible with the principle of proportionality and the theories of general prevention, individual prevention and retaliation. The proposal for tougher penalties for multiple crimes is also compatible with the asperation principle. The consequences of an implementation of these bills will be that the courts need to revise the method for calculating the total penalty value in case of multiple crimes. Furthermore, the way of determining the penalty for recidivism will change, as the recidivism is expected to have a greater impact on the determination of the penalty. In addition to the consequences the proposals have for sentencing and sentencing, they will also result in major financial consequences for both the investigating and enforcement authorities. (Less)
