- Barnets skydd i väpnade konflikter är fast förankrat i internationell rätt. Konventioner och överenskommelser som berör barn betonar deras sårbarhet och särskilda behov av skydd. Att barn ska skyddas från krig och konflikt framstår som en självklarhet. Ändå görs de till avsiktliga måltavlor av krigets förövare.
För snart 20 år sedan antog FN-medlemsstaterna en princip som ålade dem en skyldighet att skydda, The Responsibility to Protect (R2P). Kan världssamfundet infria detta löfte och skydda de konfliktdrabbade barnen?
Syftet med uppsatsen är att kritiskt granska R2P ur ett barnrättsligt perspektiv för att bedöma principens effektivitet i förhållande till skyddet av barn i väpnade konflikter. Syftet med uppsatsen är att kritiskt granska R2P ur ett barnrättsligt perspektiv för att bedöma principens effektivitet i förhållande till skyddet av barn i väpnade konflikter. Syftet genomförs genom redogörelser av R2P, det rättsliga skydd som tillkommer konfliktdrabbade barn samt vissa insatser som gjorts för att skydda dessa barn. Uppsatsens syfte uppnås genom en rättsdogmatisk metod som syftar till att fastställa gällande rätt, i huvudsak med hjälp av folkrättsliga instrument, rättsvetenskaplig litteratur och FN- dokument och rapporter. Den rättsdogmatiska metoden förser också uppsatsen med ett kritiskt förhållningssätt.
Uppsatsen kommer i en avslutande diskussion fram till att R2P i nuläget inte verkar effektivt vad gäller barns skydd, då principens utformning är för beroende av medlemsstaternas politiska viljor som enbart stundvis finns där. Problemet är att krigets fasor kvarstår för barnen. Deras enda hopp är att någon ingriper, men världen vägrar. Avslutningsvis föreslår uppsatsen därför att en reform av R2P är för handen. Conventions and other agreements concerning children emphasize their vulnerability and special need for protection. It is considered obvious that children should be protected from war and conflict. Yet, they are being deliberately targeted by perpetrators of war.
Nearly 20 years ago, UN member states adopted a principle that imposed upon them a Responsibility to Protect (R2P). But can the international community deliver on this promise and protect children affected by conflicts?

Conventions and other agreements concerning children emphasize their vulnerability and special need for protection. It is considered obvious that children should be protected from war and conflict. Yet, they are being deliberately targeted by perpetrators of war.
Nearly 20 years ago, UN member states adopted a principle that imposed upon them a Responsibility to Protect (R2P). But can the international community deliver on this promise and protect children affected by conflicts?
The purpose of this essay is to critically examine R2P from a child rights perspective in order to assess the principle’s efficiency in relation to the protection of children in armed conflicts. This purpose is achieved through explanations of R2P, the legal protection pertaining to children affected by conflicts, and certain efforts made to protect children. The essay’s purpose is met using a legal dogmatic method aimed at determining applicable law, primarily through the use of international legal instruments, legal literature, and UN documents and reports. This method also provides a critical approach to the essay.
In a concluding discussion, the essay finds that R2P is not efficient in terms of children’s protection at this moment in time. The design of the principle relies too much on the political will of member states, which is only sporadically present. The problem remains that the horrors of war persist for children. Their only hope is for someone to intervene, but the world refuses. Therefore, the essay suggests that a reform of R2P is necessary. (Less)
