Terror, kränkande motiv eller något annat? – En granskning av terroristbrottsbestämmelsens tillämpningsområde

Abstract
This thesis examines the area of application of Section 4 of the Swedish Act on Criminal Responsibility for Terrorist Offences, terroristbrottslag (2022:666). The section regulates criminal responsibility for terrorist offences. Several cases concerning terrorist crime have been subject to Swedish courts in the 2000s, most recently in December in 2022, relating to a murder carried out at the Almedalen Week earlier that year. The thesis also compares Section 4 of the Act on Criminal Responsibility for Terrorist Offences to Chapter 29, Section 2, Point 7 of the Swedish Penal Code, which regulates hate crime as basis for stricter sentencing.

This thesis examines the area of application of Section 4 of the Swedish Act on Criminal Responsibility for Terrorist Offences, terroristbrottslag (2022:666). The section regulates criminal responsibility for terrorist offences. Several cases concerning terrorist crime have been subject to Swedish courts in the 2000s, most recently in December in 2022, relating to a murder carried out at the Almedalen Week earlier that year. The thesis also compares Section 4 of the Act on Criminal Responsibility for Terrorist Offences to Chapter 29, Section 2, Point 7 of the Swedish Penal Code, which regulates hate crime as basis for stricter sentencing.

The investigation has been conducted by means of a jurisprudential method, based mainly on relevant provisions and legislative history. The results suggest that Section 4 of the Swedish Act on Criminal Responsibility for Terrorist Offences is to be applied restrictively, which is also ensured by the section’s necessary prerequisites. At the same time, however, the section may theoretically be applied on a vast number of criminal offences. Moreover, any actual damage need not have occurred. The court’s assessment in such cases may therefore be complex. Given that the legislative history does not always provide any further guidance on the matter, there may be a risk for arbitrariness. It is also concluded that both sections subject to the investigation concern similar criminal motives which, in some situations, could give rise to difficulties regarding the sections’ areas of application. I uppsatsen undersöks tillämpningsområdet för terroristbrottsbestämmelsen i terroristbrottslagen (2022:666). Bestämmelsen har varit föremål för domstolsprövning ett antal gånger under 2000-talet, bland annat så sent som i december i fjol med anledning av ett knivmord som ägde rum under Almedalsveckan samma år. Vidare undersöks vilka skillnader och likheter som finns mellan tillämpningsområdet för terroristbrottsbestämmelsen och
tillämpningsområdet för brott som begås med ett sådant motiv som avses i straffskärpningsregeln i 29 kap. 2 § 7 brottsbalken.

Samtidigt konstateras bland annat att bestämmelsen i teorin kan omfatta en stor variation av gärningstyper, samt att det inte behöver fastställas någon faktisk skada i det enskilda fallet. Den bedömning som ankommer på domstolen kan således antas kunna bli komplex. Eftersom lagens förarbeten inte ger någon tydlig anvisning avseende rekvisitens innebörd kan bedömningen vidare förknippas med en viss risk för godtycklighet. Gemensamt för terroristbrottsbestämmelsen och straffskärpningsregeln är främst att bestämmelserna tar sikte på liknande motiv för brottsligheten, vilket i vissa situationer skulle kunna innebära en viss gränsdragningsproblematik i fråga om bestämmelsernas tillämpningsområden.
