- The monitoring of employees’ electronic communications has become increasingly common over the last couple of years. As a result of the technological development in society in combination with changed forms of work, the contradiction between the employer’s interest in control and monitoring and the employee’s interest in privacy, has been brought into the spotlight. This actualizes new legal dilemmas that will be examined further in this paper.
The purpose of this study is to investigate the privacy protection in the working life in relation to employers’ monitoring of employees’ electronic communication. The study therefore focuses on investigating how to balance the employer’s monitoring interest and the employee’s privacy interest.... The purpose of this study is to investigate the privacy protection in the working life in relation to employers’ monitoring of employees’ electronic communication. The study therefore focuses on investigating how to balance the employer’s monitoring interest and the employee’s privacy interest. Furthermore, the study aims to determine whether the privacy protection that employees enjoy is sufficient, or whether there is a need for legislation regarding the issue.
The study concludes that labor management rights may consist of a right for employers to monitor employees’ electronic communications under certain circumstances. In addition, the study emphasizes that a balance must be determined between the interests of the employer and the employee, according to the criteria set out in the European Court of Human Rights practice, to be accepted. A proportionality assessment must also be carried out. Finally, it is established that the privacy protection that employees enjoy is not sufficient, as the protection is difficult to comprehend. It is therefore proposed that a law regulating employee privacy protection should be introduced into Swedish law. (Less) - Abstract (Swedish)

Uppsatsens frågeställningar besvaras och syftet förverkligas genom tillämpning av en rättsdogmatisk metod samt genom applicerandet av ett allmänt kritiskt perspektiv. Uppsatsen konstaterar att mycket talar för att arbetsledningsrätten innebär en rätt för arbetsgivare att övervaka arbetstagares elektroniska kommunikation. Vidare framhåller undersökningen att en avvägning mellan arbetsgivarens och arbetstagarens intressen måste ske enligt de kriterier som ställs upp i Europadomstolens praxis för att godtas. En proportionalitetsbedömning måste även företas. Slutligen konstateras att integritetsskyddet som arbetstagare åtnjuter inte är tillräckligt då skyddet är svåröverskådligt och mångfacetterat. Det föreslås därför att en lag som reglerar arbetstagares integritetsskydd införs i svensk rätt. (Less)
