Tjänstemannaansvar - Behövs det ändringar i det straffrättsliga ansvaret för offentligt anställda?

Personer som innehar statlig anställning är på ett sätt som vilka arbetstagare som helst. PÅ ett annat sätt så är dem representanter för staten och deras ageranden påverkar allmänhetens uppfattning och tilltro till staten och dess myndigheter. Därför har man under perioder särskilt denna arbetstagargrupp från övriga arbetstagare då det har gällt striktare regler vid fel begångna i sin tjänsteutövning. Sedan 1970-talet har man dock velat att de arbetsrättsliga regleringarna som gäller för statlig verksamhet ska vara densamma som i den privata sfären. PÅ ett annat sätt så är dem representanter för staten och deras ageranden påverkar allmänhetens uppfattning och tilltro till staten och dess myndigheter. Därför har man under perioder särskilt denna arbetstagargrupp från övriga arbetstagare då det har gällt striktare regler vid fel begångna i sin tjänsteutövning. Sedan 1970-talet har man dock velat att de arbetsrättsliga regleringarna som gäller för statlig verksamhet ska vara densamma som i den privata sfären. Dock finns det fortfarande vissa ökade krav på en om man sysslar med offentlig myndighetsutövning. Till exempel så krävs det att felen begås i myndighetsutövning för att man i enlighet med BrB 20:1§ ska dömas för tjänstefel. Vidare gäller andra krav när det gäller arbetstagarens i offentlig tjänsts brottslighet än vad som gäller för arbetstagare generellt, något som Arbetsdomstolen har uttalat i många avgöranden. Det finns dock från politiskt håll en vilja att skärpa lagstiftningen kring offentligt anställda och återinföra tjänstemannaansvar. I dokumentet som låg till grund för det regeringssamarbete som de fyra partierna Moderaterna, Kristdemokraterna, Liberalerna och Sverigedemokraterna, det så kallade Tidöavtalet, presenterades diverse frågor som det nya regeringssamarbetet skulle verka för. En av punkterna på listan är införandet av ett nytt tjänstemannaansvar. Syftet med detta är, enligt partierna, att stärka åtgärderna mot tjänstefel och även att utvidga ansvaret även för sådant myndighetsarbete som inte är myndighetsutövning, till exempel offentliga upphandlingar. Detta har mötts av blandade reaktioner. Fackförbundet ST, som är fackförbundet för statligt anställda tjänstemän, kritiserar det nya förslaget och menar att dagens system fungerar väl. Vidare framför ST att de tror tjänstemannens roll kommer försvagas vid ett införande av förslaget, samt att det kommer leda till en ökad osäkerhet och noggrannhet från statligt anställda vilket leder till sämre service för allmänheten. Samtidigt finns det många som står bakom förslaget, och ämnet har varit föremål för debatt under lång tid. (Less)

People who hold government employments are in a way like any other workers. In another way, they are representatives of the state and their actions affect the public's perception and trust in the state and its authorities. Therefore, during periods, this group of workers in particular has been separated from other workers and stricter rules have applied in the event of errors committed in the performance of their duties. Since the 1970s, however, it has been desired that the labor related laws and regulations that apply to government activities should be the same as in the private sphere. In another way, they are representatives of the state and their actions affect the public's perception and trust in the state and its authorities. Therefore, during periods, this group of workers in particular has been separated from other workers and stricter rules have applied in the event of errors committed in the performance of their duties. Since the 1970s, however, it has been desired that the labor related laws and regulations that apply to government activities should be the same as in the private sphere. However, there are still certain increased demands on one if you are engaged in the exercise of public authority. For example, it is required that the errors are committed in the exercise of authority in order to be sentenced for misconduct in accordance with BrB 20:1§. Furthermore, different requirements apply with regard to the employee's criminality in public service compared to employees in general, something that the Labor Court (Arbetsdomstolen) has stated in many rulings. There is, however, from a political point of view, a will to tighten the legislation around public employees and reintroduce white-collar liability. In the document that was the basis for the government cooperation between the four parties Moderaterna, Kristdemokraterna, Liberalerna and Sverigedemokraterna, the so-called Tidö Agreement, various issues were presented for which the new government cooperation would work. One of the items on the list is the introduction of a new responsibility for employees in the public sphere. The purpose of this is, according to the parties, to strengthen the measures against misconduct and also to extend the responsibility also for such official work that is not the exercise of authority, for example public procurement. This has been met with mixed reactions. The union ST, which is the union for state-employed civil servants, criticizes the new proposal and believes that the current system works well. Furthermore, ST states that they believe the role of the civil servant will be weakened if the proposal is introduced, and that it will lead to increased uncertainty and accuracy from government employees, which leads to poorer service for the public. At the same time, there are many who stand behind the proposal, and the subject has been the subject of debate for a long time. (Less)
