Koranbränningar och konsekvenser - En utredning om yttrandefrihetens relation i proportion till allmän ordning och säkerhet

Under 2000-talet har det skett många olika manifestationer i de nordiskaländerna, som ofta utmanat samhällets syn på vad som utgör en godtagbar demonstration och huruvida tydliga gränser bör sättas i medborgarnas yttrandefrihet. Ett exempel på detta har varit Rasmus Paludans manifestationer i Sverige och Danmark där han har tänt eld på Koranen, vilka i många fall har urartat. Under påsken 2022 eskalerade det och resulterade i ett våldsamt upplopp i flera svenska städer. Detta har väckt en het debatt och det har blivit tydligt att problemen är mångfacetterade.

Ett exempel på detta har varit Rasmus Paludans manifestationer i Sverige och Danmark där han har tänt eld på Koranen, vilka i många fall har urartat. Under påsken 2022 eskalerade det och resulterade i ett våldsamt upplopp i flera svenska städer. Detta har väckt en het debatt och det har blivit tydligt att problemen är mångfacetterade.
Uppsatsen syftar till att utreda och analysera den svenska mötes- och demonstrationsfriheten i ljuset av de ökade konflikterna i samband med demonstrationer. Frågeställningarna fokuserar således på hur mötes- och demonstrationsfriheten regleras i svensk rätt, hur den appliceras i domstolarna och hur intresseavvägningen görs mellan den enskildes intressen att uttrycka sig gentemot det allmännas intresse av lag och ordning genom en rättsdogmatisk metod.
Uppsatsen presenterar lagstiftningen i form av de friheter som stadgas genom regeringsformen och de inskränkningar genom lag som återfinns i ordningslagen. Vidare presenteras och analyseras tillämpningen av lagen i tre rättsfall i efterföljande processer efter de koranbränningar och ansökningar om att utföra koranbränningar som skett under våren 2022. I samtliga rättsfall har domstolarnas bedömning utmynnat i att yttrandefriheten inte skulle ha begränsats med hänvisning till allmän ordning. I uppsatsens analys av rättsfallen konstateras att domstolarnas slutsatser, med beaktande av det rättsliga utgångsläget och de proportionalitetsbedömningar som gjort, inte kunnat bli annorlunda. Mot den bakgrunden lyfts frågan om ordningslagen, med hänsyn till konsekvenserna av upploppen i anslutning till koranbränningar, bör reformeras. (Less)

In the 2000s there have been many different demonstrations in the Nordic countries, often challenging society's view of what constitutes an acceptable demonstration and whether clear limits should be placed on citizens' freedom of expression. An example of this has been Rasmus Paludan's demonstrations in Sweden and Denmark where he has set fire to the Koran, which in many cases have degenerated. During Easter 2022, this escalated and resulted in a violent riot in several Swedish cities. This has sparked a heated debate and it has become clear that the problems are multifaceted.

An example of this has been Rasmus Paludan's demonstrations in Sweden and Denmark where he has set fire to the Koran, which in many cases have degenerated. During Easter 2022, this escalated and resulted in a violent riot in several Swedish cities. This has sparked a heated debate and it has become clear that the problems are multifaceted.
The paper aims to investigate and analyze the Swedish freedom of assembly and demonstration in light of the increased conflicts in connection with demonstrations. The questions thus focus on how the freedom of assembly and demonstration is regulated in Swedish law, how it is applied in the courts and how the interests of the individual to express themselves are weighed against the public interest of law and order through a legal dogmatic method.
The paper presents the legislation in the form of the freedoms set out in the Swedish Constitution and the restrictions by law found in the Public Order Act. Furthermore, the application of the law is presented and analyzed in three court cases in subsequent processes after the Koran burnings and applications to carry out Koran burnings that took place in the spring of 2022. In all court cases, the courts' assessment has resulted in that freedom of expression should not have been limited with reference to public order. In the essay's analysis of the cases, it is noted that the courts' conclusions, taking into account the legal starting point and the proportionality assessments made, could not have been different. Against this background, the question is raised whether the Public Order Act should be reformed, given the consequences of the riots in connection with Koran burning. (Less)
