Anteciperat avtalsbrott, även så kallat befarat avtalsbrott regleras i bestämmelserna 61-63 §§ KöpL. För att kunna hålla inne sin prestation krävs det att starka skäl ska föreligger följt av ett flertal rekvisit, till exempel att det ska röra sig om en viss väsentlighet. Det ska med andra ord finnas starka misstankar om att motparten inte kommer att uppfylla en väsentlig del av sina prestationer. Stoppningsrätten regleras i 61 § KöpL där utrymme för tolkning finns. Stoppningsrätten regleras även i CISG och skiljer sig aningen, det är relevant att diskutera stoppningsrättens innebörd och utövande i CISG för att kunna fastställa gällande rätt i 61 § KöpL. In other words, there must be strong suspicions that the counterparty will not fulfill a substantial part of the obligated performance. In other words, there must be strong suspicions that the counterparty will not fulfill a substantial part of the obligated performance. The stoppage right is regulated in 61 § KöpL where there is scope for interpretation. The right of withdrawal is also regulated in CISG and differs slightly. It is relevant to discuss the meaning and exertion of the right of withdrawal in the CISG in order to determine the applicable law in § 61 KöpL. The stoppage right is not regulated in Swedish consumer laws, but HD has stated that it is of great importance within the whole of contract law, an analogous application should therefore be applicable. The purpose of the essay is to investigate and analyze the parties' right of termination as a result of anticipated (suspected) breach of contract according to § 61 KöpL. (Less)
