Sverige har ur ett internationellt perspektiv kommit långt i dess arbete för att förebygga våld i nära relationer såväl som våld i anknytningsrelationer. I Sverige finns rättsregler för att skydda kvinnor som utsätts för våld av sin anknytningsperson genom att låta dem stanna i landet med ett självständigt tillstånd trots att förhållandet har upphört. Kraven för att uppbära ett självständigt tillstånd ställs dock högt och våldsbegreppet är inte att tolka på samma sätt som i andra delar av rätten.

Vilka effekter kritiken i GREVIO:s rapport 2019 har haft på skyddet för kvinnor som utsätts för våld i anknytningsrelationer och vilka åtgärder som kvarstår utreds ur ett rättsutvecklings- och kritiskt perspektiv. Utredningen genomförs genom en rättsdogmatisk och rättsanalytisk metod. Uppsatsen identifierar ändringar som gjorts i förhållande till kvinnor vars anknytningsperson uppbär ett tidsbegränsat tillstånd, som numera efter GREVIO:s kritik, kan få uppehållstillstånd i enlighet med skyddsregeln i 5 kap. 16 § UtlL. Uppsatsen identifierar vidare de luckor som behöver åtgärdas vad gäller kvinnor i anknytningsrelationers skydd när de utsätts för våld. Luckorna är kravet på att våld ska vara den primära orsaken till uppbrottet i relationen och att våldet måste ha varit allvarligt och upprepat. GREVIO framför även kritik gällande kravet på en viss sammanboendetid samt att förhållandet ska ha varit seriöst. Ovan nämnda luckor kan innebära en inlåsningseffekt för kvinnor i våldsamma relationer eftersom de på grund av rädsla för att tvingas lämna Sverige stannar med sin våldsamma partner. Luckorna behöver fyllas för att överensstämma med den kritik som GREVIO framför såväl som att följa den nolltolerans till våld som finns i Sverige och som Istanbulkonventionen uppställer. (Less)
Abstract
Sweden has made significant strides internationally in its efforts to prevent domestic violence as well as violence towards women who have immigrated into Sweden to enter an intimate relationship. In Sweden there are legal regulations to protect immigrant women exposed to male partner violence by allowing them to remain in the country with a new residence permit of their own, even after the relationship has ended. However, the requirements for obtaining such a permit are stringent and the concept of violence is not interpreted in the same way as in other judicial areas.

Sweden has made significant strides internationally in its efforts to prevent domestic violence as well as violence towards women who have immigrated into Sweden to enter an intimate relationship. In Sweden there are legal regulations to protect immigrant women exposed to male partner violence by allowing them to remain in the country with a new residence permit of their own, even after the relationship has ended. However, the requirements for obtaining such a permit are stringent and the concept of violence is not interpreted in the same way as in other judicial areas.

The effects and remaining measures of the criticism in GREVIO´s 2019 report in regard to protection of immigrant women experiencing violence by a male partner in Sweden is investigated. The investigation is conducted through a legal developmental and critical perspective along with a legal dogmatic and legal analytical methodology. The essay identifies that changes have been made concerning women whose partner holds a temporary residence permit. These women can now, after GREVIO´s criticism, obtain a residence permit in accordance with the “skyddsregel” in chapter 5 section 16 of the Aliens Act that was not possible before. Additionally, this essay identifies gaps in the legal system that need to be addressed regarding the protection of immigrant women facing male partner violence. These gaps include the requirement that violence should be the primary cause of the relationship ending and that the violence must have been severe and repeated. GREVIO also criticizes the requirement for a certain cohabitation period and that the relationship must have been serious. The gaps may result in women being trapped in a cycle of abuse in their violent relationships as the women due to fear of being forced to leave Sweden might stay with their violent partner. These gaps need to be addressed to align with the criticism put forth by GREVIO and to adhere to the zero tolerance for violence in Sweden, as outlined by the Istanbul Convention. (Less)
