Anhörigbehörigheten i Sverige och Norge - En jämförande utvärdering av de första åren med regleringen

Abstract
To give a relative a competence to represent a member of the family directly with legal authority is new in both Sweden and Norway. The rules came into effect 1 July 2013 in Norway and 1 July 2017 in Sweden. The effect of the new rules is that a relative can help a member of the family manage financial affairs which concerns the daily living when the family member is unable to do so due to health condition.
This paper examines the purpose behind the regulation, the differences between the regulation in Sweden and Norway, what the legal cases concerning the rules so far has dealt with and what criticism was directed towards the regulation before it came into effect.

To give a relative a competence to represent a member of the family directly with legal authority is new in both Sweden and Norway. The rules came into effect 1 July 2013 in Norway and 1 July 2017 in Sweden. The effect of the new rules is that a relative can help a member of the family manage financial affairs which concerns the daily living when the family member is unable to do so due to health condition.
This paper examines the purpose behind the regulation, the differences between the regulation in Sweden and Norway, what the legal cases concerning the rules so far has dealt with and what criticism was directed towards the regulation before it came into effect.
The conclusion is that the regulation of a competence for relatives in Sweden and Norway is proportionately alike. Some differences exist in where the countries have chosen to place the rules in the text of law. In Sweden there are rules about conflict of interest and compensation to the family member if the relative exceeds the competence. This has no parallel in Norway. In Norway it is clearer that the competence only covers financial affairs.
Based on the legal cases presented in this paper nothing indicates that there are any serious problems concerning the new competence. The paper also concludes that the competence for a relative does not take care of the existing need for help, but still serves a purpose and that it is positive that there now are more options to meet the need for help. Att ge anhöriga en behörighet att företräda en familjemedlem direkt med stöd av lag är nytt både i Sverige och Norge. Reglerna infördes i Norge 1 juli 2013 och i Sverige 1 juli 2017. Innebörden av de nya reglerna är att en anhörig får hjälpa en familjemedlem att sköta ekonomiska angelägenheter kopplat till den dagliga livsföringen när familjemedlemmen på grund av sitt hälsotillstånd inte kan göra det.
Uppsatsen undersöker vad syftet bakom regleringen var, vilka skillnader som finns mellan Sverige och Norge, vad rättsfallen som hittills berört reglerna har handlat om och vilken kritik som riktades mot reglerna före införandet.

I Sverige finns bestämmelser om skadestånd och jäv, vilket inte har någon motsvarighet i Norge. I Norge framgår det tydligare att det endast är ekonomiska angelägenheter som omfattas av behörigheten.
Utifrån rättsfallen som redovisas i uppsatsen tyder inget på att det finns några allvarliga problem med den nya behörigheten. Uppsatsen kommer även fram till att behörigheten för anhöriga inte åtgärdar det hjälpbehov som finns, men att den ändå fyller ett syfte samt att det är positivt att det nu finns fler alternativ för att möta hjälpbehovet som finns.
