Hyresundantaget i 3:19 LOU - Hur ser tillämplighetsområdet ut i förhållande till entreprenadarbeten enligt rättslig praxis?

Uppsatsen fokuserar på de tidigare aspekterna av kvalificeringen av kontrakt inom EU-rätten, särskilt beträffande tjänstekontrakt och byggentreprenadkontrakt som tidigare reglerades i separata direktiv. Dessa kvalificeringar var väsentliga för att fastställa vilket specifikt direktiv som skulle tillämpas på ett givet kontrakt. I den svenska praxisen har fokus inte enbart legat på att avgöra om ett kontrakt är ett byggentreprenadkontrakt eller ett tjänstekontrakt, utan även om det kan klassificeras som ett hyreskontrakt. Vidare kan det noteras att även om det inte tydligt framgår av det klassiska upphandlingsdirektivet kan hyresundantaget troligen inte tillämpas på ett hyresavtal där hyresdelen utgör en sekundär del i förhållande till övriga tjänsterelaterade aspekter i kontraktet. Uppsatsen understryker också att flera separata avtal som en upphandlande myndighet ingår med en leverantör ibland kan bedömas som en helhet om de är nära sammankopplade eller inte kan tillämpas separat. Detta trots att upphandling av tjänstekontrakt och byggentreprenadkontrakt numera regleras i ett och samma direktiv, vilket ibland kräver fortsatt kvalificering av avtalen. (Less)

The lease exemption has its limitations and, for instance, cannot be applied to contracts related to construction, either according to the wording of the directive or according to the Public Procurement Act (LOU). Furthermore, it can be noted that even if it is not explicitly stated in the classic procurement directive, the lease exemption probably cannot be applied to a lease agreement where the leasing part is a secondary component in relation to other servicerelated aspects in the contract. The essay also emphasizes that several separate agreements entered into by a contracting authority with a supplier can sometimes be assessed as a whole if they are closely interconnected or cannot be applied separately. This is despite the fact that the procurement of service contracts and construction contracts is now regulated in the same directive, which sometimes requires continued qualification of the agreements.
