- Uppsatsen undersöker cyberoperationer inom jus ad bellum-regimen, där reglerna återfinns främst uttryckta i FN-stadgan. Inom ramen för arbetet är cyberoperationer försök att ändra, störa eller förstöra datorsystem eller nätverk, alternativt information eller program på dessa, med ett politiskt intresse eller säkerhetsintresse. Användning av traditionella vapen exkluderas från definitionen.
Frågeställningarna inkluderar huruvida cyberoperationer kan klassificeras som våldshandlingar och väpnade attacker inom regimen, samt om de bör kunna göra det. Genom att ta hjälp av litteratur på området, relevanta domstolsavgöranden och rådgivande yttranden från Internationella domstolen har frågeställningarna besvarats. Till viss del har även... Frågeställningarna inkluderar huruvida cyberoperationer kan klassificeras som våldshandlingar och väpnade attacker inom regimen, samt om de bör kunna göra det. Genom att ta hjälp av litteratur på området, relevanta domstolsavgöranden och rådgivande yttranden från Internationella domstolen har frågeställningarna besvarats. Till viss del har även tolkning av traktaten i enlighet med erkända principer inom internationell rätt gjorts.
Uppsatsen är indelad i fem delar. Först undersöks bland annat frågeställningar, metod och disposition. Sedan redogörs för hur cyberoperationer fungerar, innan uppmärksamhet vänds till reglering av mellanstatligt våld i jus ad bellum-regimen. Redogörelsen om reglering av mellanstatligt våld utgår ifrån hur det uttryckts i FN-stadgan. Diskussion hålls därefter och uppsatsen slutförs sedan i avslutande reflektioner.
Utredningen föreslår att cyberoperationer som resulterar i fysisk destruktion kan klassificeras som våldshandlingar. Cyberoperationer med fysisk destruktion av viss skala och effekt kan vidare anses vara väpnade attacker. Uppsatsen konkluderas med att dagens förståelse av våldshandlingar och väpnade attacker inte på ett tillfredsställande sätt tar hänsyn till destruktiva konsekvenser av cyberoperationer som inte manifesteras fysiskt. Research questions include whether cyber operations can be classified as uses of force and armed attacks under the current regime, and if they should be able to be classified as such. This thesis is sectioned into five parts. Firstly, an introduction to the thesis is made, where research questions, methodology and disposition are explored. Secondly, a description of how cyber operations function before thirdly, the regulation on interstate violence in the jus ad bellum-regime, as expressed in the UN Charter, is accounted for. Fourthly, a discussion is held, and fifthly, concluding reflections are made.
This study argues that cyber operations can be classified as uses of force or as armed attacks, crucial for the judgment is whether the operations results in physical destruction. To classify a cyber operation as an armed attack the operation furthermore needs to surpass a certain threshold of scale and effects. Current understanding of use of force and armed attack does not to a satisfactory level accommodate for cyber operations destructive conse- quences that do not manifest in the physical domain. (Less)
