- Genom den teknologiska utvecklingen har det under de senaste åren blivit möjligt att med hjälp av AI generera bilder. Processen skiljer sig från hur bilder tidigare har framställts och människan kan nu mer än någonsin vara passiv i skapandeprocessen. Den nya metoden att framställa bilder väcker nya frågor avseende upphovsrätten. Uppsatsen undersöker en av dessa frågor - nämligen huruvida människan får upphovsrätt till de AI-genererade bilderna. Det råder olika uppfattningar i doktrinen, där ena sidan menar att upphovsrätt uppkommer när människan gör fria val i skapandeprocessen och andra sidan som menar att människans kreativa uttryck även måste objektivt framgå i den slutliga utformningen och att människan därför behöver behålla... Processen skiljer sig från hur bilder tidigare har framställts och människan kan nu mer än någonsin vara passiv i skapandeprocessen. Den nya metoden att framställa bilder väcker nya frågor avseende upphovsrätten. Uppsatsen undersöker en av dessa frågor - nämligen huruvida människan får upphovsrätt till de AI-genererade bilderna. Det råder olika uppfattningar i doktrinen, där ena sidan menar att upphovsrätt uppkommer när människan gör fria val i skapandeprocessen och andra sidan som menar att människans kreativa uttryck även måste objektivt framgå i den slutliga utformningen och att människan därför behöver behålla tillräcklig kontroll över alstret. Analysen tar utgångspunkt i den andra uppfattningen som mot bakgrund av tidigare rättsfall verkar vara mer sannolik. På grund av bristande kontroll och att idéer inte omfattas av upphovsrätten, är det osannolikt att upphovsrätten kan uppkomma endast på grundval av att människan matar in en textbeskrivning i AI-systemet för att generera en bild. Det är också osannolikt att upphovsrätten uppkommer på grund av att människan väljer en av bildversionerna som genereras därefter. Människan kan däremot välja att generera fortsatta ändringar i den utvalda bilden, vilket kanske kan öka kontrollen av den slutliga utformningen. (Less)

This process differs from traditional methods of image creation, allowing humans to be more passive in the creative process than ever before. The new method of generating images raises new questions regarding copyright. This essay explores one of these questions – namely, whether humans are entitled to copyright for AI-generated images. There are different opinions in legal doctrine; one side argues that copyright arises when humans make free choices in the creative process, while the other side contends that the human's creative expression must objectively manifest in the final design, requiring sufficient control over the creation. This process differs from traditional methods of image creation, allowing humans to be more passive in the creative process than ever before. The new method of generating images raises new questions regarding copyright. This essay explores one of these questions – namely, whether humans are entitled to copyright for AI-generated images. The analysis is based on the latter viewpoint, which, given precedent cases, appears more likely. Due to a lack of control and the fact that ideas are not protected by copyright, it is unlikely that copyright can arise solely because a person inputs a text description into an AI system to generate an image. It is also improbable that copyright arises simply because a person selects one of the generated image versions. However, individuals can choose to make further modifications to the selected image, potentially increasing control over the final design. (Less)
