- Uppsatsen behandlar den europeiska idrottsmodellens förhållande till EU:s konkurrenslagstiftning. I synnerhet problematiseras de europeiska idrottsförbundens monopolställning och detta ska vägas mot intresset av att beakta idrottens specifika karaktär, som uttrycks i artikel 165 FEUF.
Uppsatsen belyser de centrala aspekterna av den europeiska idrottsmodellen samt de mål som präglar EU:s idrottspolitik. I uppsatsen redogörs för relevant praxis, som visar på att artikel 165 FEUF inte innebär att idrotten bör särbehandlas men att det finns en villkorlig autonomi som accepterar idrottens särdrag under förutsättningen att de anses nödvändiga. Som komplement till praxis utforskas olika synsätt på reglering, autonomi och kommersialisering genom att jämföra den europeiska idrottsmodellen med den amerikanska motsvarigheten samt genom att lyfta relevant doktrin.
Uppsatsen argumenterar för att förändring är nödvändig och att en balans mellan idrottens autonomi och efterlevnad av konkurrensrätten kan uppnås genom proaktiva åtgärder från EU. Relevant legal precedents are presented, demonstrating that Article 165 TFEU does not imply that sports should be treated differently. Instead, it indicates a conditional autonomy that accepts the unique features of sports, provided they are deemed necessary. In...
