Denna uppsats granskar det komplexa rättsläget kring "joint bidding" inom offentlig upphandling och analyserar specifikt konsekvenserna av uteslutningsgrunden i 13 kap. 3 § p. 4 LOU. Uppsatsen undersöker i vilken utsträckning konkurrensrätten kan tillämpas på "joint bidding" och hur uteslutningsgrunden påverkar denna samarbetsform vid offentliga upphandlingar. Konkurrensrättens centrala roll i att förhindra kartellbildning och säkerställa marknadseffektivitet ställs mot behovet av samarbeten vid stora offentliga projekt. Denna uppsats granskar det komplexa rättsläget kring "joint bidding" inom offentlig upphandling och analyserar specifikt konsekvenserna av uteslutningsgrunden i 13 kap. 3 § p. 4 LOU. Uppsatsen undersöker i vilken utsträckning konkurrensrätten kan tillämpas på "joint bidding" och hur uteslutningsgrunden påverkar denna samarbetsform vid offentliga upphandlingar. Konkurrensrättens centrala roll i att förhindra kartellbildning och säkerställa marknadseffektivitet ställs mot behovet av samarbeten vid stora offentliga projekt. Utmaningen ligger i att definiera det "objektivt nödvändiga" samarbetet för att undvika överdriven begränsning av konkurrensen. Uppsatsen betonar behovet av tydligt formulerade krav i offentliga upphandlingar för att underlätta bedömningen för leverantörer.
Insikten att "joint bidding" motiveras av strategiska skäl, där leverantörer väljer partners för optimal effektivitet eller för att hantera oväntade händelser, är särskilt betydelsefull. Det är en central aspekt som får begränsat utrymme vid uteslutningsbeslut.
Därtill har EU-domstolen fastslagit att konkurrensrättsliga bedömningar bör vara vägledande för upphandlande myndigheters beslut att utesluta en leverantör. Detta komplexa förhållningssätt kompletterar den övergripande förståelsen av uteslutningsgrunden. Sedan har EU-domstolen även konstaterat att bedömningen av 13 kap. 3 § p. 4 LOU inte enbart bör baseras på kriterierna för konkurrensrättsliga förbud, eftersom uteslutningsgrunden inte är avsedd att klassificera en konkurrensöverträdelse rättsligt.
Genom att integrera dessa rättsliga aspekter ger uppsatsen en djupare insikt i det komplexa samspelet mellan konkurrensrätt och offentlig upphandling. Detta bidrar inte bara till den teoretiska diskussionen utan ger också en konkret förståelse för de utmaningar och möjligheter som företag och upphandlande myndigheter står inför vid "joint bidding". The study explores the extent to which competition law can be applied to "joint bidding" and how the exclusion clause affects this form of collaboration in public procurement.
