Barn är monster och samhället behöver skyddas – En kritisk analys av utredningens förslag att avskaffa sluten ungdomsvård utifrån den historiska utvecklingen av frihetsberövande påföljder

Ungdomsbrottslighet har konsekvent varit föremål för diskussion. Frågan om hur samhället ska
reagera mot ungdomsbrottslighet är en återkommande fråga. I förevarande uppsats följer en
historisk utveckling av vilka straffrättsliga frihetsberövande påföljder som funnits för barn. Med
hjälp av den kriminalpolitiska utvecklingen beträffande synen på ungdomsbrottslighet ger
uppsatsen ett perspektiv på vad som kan motivera en reaktion från samhället.

Ungdomsbrottslighet har konsekvent varit föremål för diskussion. Frågan om hur samhället ska
reagera mot ungdomsbrottslighet är en återkommande fråga. I förevarande uppsats följer en
historisk utveckling av vilka straffrättsliga frihetsberövande påföljder som funnits för barn. Med
hjälp av den kriminalpolitiska utvecklingen beträffande synen på ungdomsbrottslighet ger
uppsatsen ett perspektiv på vad som kan motivera en reaktion från samhället.

Barn har länge särbehandlats i det svenska rättssystemet. Samtidigt växer en politisk samsyn om
en strängare kriminalpolitik fram. Politiker betonar att fokus skiftar från gärningsperson till
samhällsskydd och brottsoffer. Den 14 augusti 2023 presenterades en utredning ett förslag om att
avskaffa sluten ungdomsvård. Mot bakgrund av detta har uppsatsens syfte varit att undersöka
huruvida utredningens förslag om att avskaffa sluten ungdomsvård innebar en förändrad syn på
barn.

Utredningens förslag om att avskaffa sluten ungdomsvård motiveras med att samhället har
förändrats sedan sluten ungdomsvård infördes, att det skett straffskärpningar, behovet av säkra
inlåsningar, trygghet för brottsoffer och samhället i övrigt samt en renodling mellan vård och
straff. Kriminalvården ska således ta över ansvaret för kriminella ungdomar, medan SiS ansvarar
för vård.

Uppsatsens analys visar att kriminalpolitiska diskussioner om ungdomsbrottslighet påverkat
reaktioner mot barn. Det har funnit olika uppfattningar om hur det allmänna ska komma åt
ungdomsbrottslighet. Från att tidigt handla om behandling av individ och samhällsskydd, till att
successivt mer handla om att straffet ska relatera till brottets allvar och samhällsskydd. Principen
om att hålla barn utanför Kriminalvården börjar förändras och istället ska det vara tydligt om det
handlar om vård eller straff. Vidare visar analysen att skyddet mot allvarlig brottslighet ställs före
att hålla barn utanför fängelsemiljön.
Slutligen är slutsatsen att om lagstiftaren väljer att avskaffa sluten ungdomsvård kan det innebära
en förändrad syn på barn. (Less)

Youth crime has consistently been the subject of debate. The question of how society should
react to juvenile offences is an ongoing debate. This paper follows the historical development of
the criminal law sanctions related to the deprivation of liberty for children. With the help of the
development of criminal policy regarding the view of juvenile offences, the paper provides a
perspective on what can justify a reaction from society.
Juveniles have long been treated differently in the Swedish legal system. At the same time, there

the criminal law sanctions related to the deprivation of liberty for children. With the help of the
development of criminal policy regarding the view of juvenile offences, the paper provides a
perspective on what can justify a reaction from society.
Juveniles have long been treated differently in the Swedish legal system. At the same time, there
is a growing political consensus on a stricter criminal policy. Politicians emphasise that the focus
is shifting from the offender to the protection of society and victims. On 14 August 2023, a
proposal was presented by the Swedish Government Official Report to abolish institutional care
of young offenders. In light of this, the purpose of this paper has been to investigate whether the
committee's proposal to abolish institutional care of young offenders meant a changed view of
children.
The committee's proposal is motivated by the fact that society has changed since institutional
care of young offenders was introduced, that sentences have been increased, the necessity for
secure confinement, security for victims of crime and society in general, and to establish a
clearer distinction between care and punishment. Consequently, the Swedish Prison and
Probation Service will assume responsibility for young offenders, while the Swedish National
Board of Institutional Care will be responsible for providing care.
The analysis shows that criminal policy discussions on youth crime have influenced reactions
towards children. There have been different perspectives on how society should address juvenile
delinquency. From early on, the focus was on treatment of the individual and protection of
society, to gradually becoming more about the punishment being related to the seriousness of the
offence and protection of society. The principle of keeping children out of the Prison and
Probation Service is beginning to change, and there is instead a growing need to clearly
distinguish between care and punishment. Furthermore, the analysis shows that protection
against serious crime is prioritised over keeping children out of the prison environment.

Finally, the conclusion is that if the legislator chooses to abolish institutional care of young
offenders, this may mean a change in the view of children. (Less)
