The UN Security Council’s sanction practice and the principle of proportionality

- Abstract
- This essay explores the UN's implementation of sanction regimes and its adherence to the proportionality principle. The research focuses on two main objectives: identifying the principle of proportionality manifestation in the UN Charter and Security Council policies, as well as assessing if the Security Council adhere to its own policies regarding the proportionality principle.
A doctrinal legal approach is employed, to shed light on the existing legal landscape. This essay focus specifically on three sanctions regimes imposed by the United Nations Security Council on Iraq, the Taliban, and Haiti. The findings reveal a nuanced landscape where the Security Council's actions show both alignment with proportionality and some areas of... The research focuses on two main objectives: identifying the principle of proportionality manifestation in the UN Charter and Security Council policies, as well as assessing if the Security Council adhere to its own policies regarding the proportionality principle.
A doctrinal legal approach is employed, to shed light on the existing legal landscape. This essay focus specifically on three sanctions regimes imposed by the United Nations Security Council on Iraq, the Taliban, and Haiti. The findings reveal a nuanced landscape where the Security Council's actions show both alignment with proportionality and some areas of ambiguity. The UN Charter, particularly Articles 39, 41, and 42, somewhat establishes the legal foundation for the proportionality principle, but still grants significant discretion on how the principle should be fulfilled. The essay therefore dives deeper into the UN policies regarding the Security Council’s implementation of sanctions. Which concluded that humanitarian exemptions and the evolution towards targeted sanctions have become the Security Council’s primary method to address concerns regarding sanctions negative impact on innocent third parties.
The conclusion underscores the need for continued scrutiny and refinement of measures to ensure that the Security Council's actions genuinely align with the principle of proportionality. Recommendations include ongoing efforts to balance coercive measures effectiveness with minimizing unintended negative effects on vulnerable populations and refining sanctions in response to evolving demands of international peace and security. Rekommendationer inkluderar pågående ansträngningar för att balansera sanktioners effektivitet med att minimera oavsiktliga negativa effekter på sårbara befolkningsgrupper och att fortsätta finjustera sanktioner som svar på de föränderliga kraven inom internationell fred och säkerhet.
