Abstract
The possibility of being granted a residence permit on the basis of affiliation has long been possible under Swedish legislation. The downside of the sys-tem is that the family member's residence permit is dependent on the person to which he/she are affiliated with, so a lock-in effect can arise in cases of vio-lence. In an attempt to mitigate the negative consequences of the regulation, the legislator has introduced a protective rule that enables continued residence permits to be granted when the relationship has ended as a consequence of the violence. The possibility of being granted a residence permit on the basis of affiliation has long been possible under Swedish legislation. The downside of the sys-tem is that the family member's residence permit is dependent on the person to which he/she are affiliated with, so a lock-in effect can arise in cases of vio-lence. In an attempt to mitigate the negative consequences of the regulation, the legislator has introduced a protective rule that enables continued residence permits to be granted when the relationship has ended as a consequence of the violence. Legal developments in recent years have led to that immigration reg-ulations have been tightened and restricted in some areas, including the possi-bility of residence permits for relatives. This thesis aims to investigate the ex-tent to which the regulation on affiliation have changed. It examines how the legal protection of family members exposed to violence through continued residence permits has been affected as a result of the of recent years’ regulato-ry changes.
The circumstances for who has been able to be reunited with their partners has varied in recent years. Spouses and cohabitants have always had the right to family reunification, while the possibility for future spouses and cohabitants has not been as obvious. The protection rule was originally aimed at relatives who had been granted a temporary residence permit with a deferred immigration assessment. Today, the protection is aimed at all family members, as no one receives a permanent permit immediately. The protection has thus come to have a somewhat different function than it did initially. Möjligheten att beviljas uppehållstillstånd på grund av anknytning har sedan länge varit möjligt enligt det svenska regelverket. Systemets baksida är att den anhöriges uppehållstillstånd är beroende av anknytningspersonen varför en inlåsningseffekt kan uppstå vid våldsutsatthet. Som i ett försök att mildra reg-lernas negativa följder har lagstiftaren infört en skyddsregel som möjliggör att fortsatt uppehållstillstånd ändå kan beviljas när relationen har upphört som en konsekvens av våldet. Vilka som haft möjlighet att återförenas med sina partner har varierat senaste åren. Makar och sambor har alltid haft rätt till familjeåterförening medan bli-vande makar och sambors möjlighet till detta inte varit lika självklar. Skydds-regeln riktade sig ursprungligen till de anhöriga som beviljats tidsbegränsat uppehållstillstånd med uppskjuten invandringsprövning. Idag riktar sig skyd-det till alla anhöriga eftersom ingen får ett permanent tillstånd direkt. Skyddet har därigenom kommit att få en delvis annan funktion än vad som gällde till en början. (Less)
