- Distansavtalslagen har genomgått flera lagändringar och utvecklats i samband med digitaliseringens utbredning. Det har medfört en ökad användning av digitala tjänster och varor med digitalt innehåll. Utformningen av distansavtalslagens konsumentskyddande bestämmelser har även påverkats av moderniserade EU-rättsakter, som införts i syfte att harmonisera bestämmelserna för den gränsöverskridande handeln inom EU. Uppsatsen ämnar att redogöra för distansavtalslagens rättsliga utformning utifrån gällande rätt och införlivandet av EU:s rättsakter om konsumentskyddande bestämmelser i svensk rätt. Utformningen av distansavtalslagens konsumentskyddande bestämmelser har även påverkats av moderniserade EU-rättsakter, som införts i syfte att harmonisera bestämmelserna för den gränsöverskridande handeln inom EU. Uppsatsen ämnar att redogöra för distansavtalslagens rättsliga utformning utifrån gällande rätt och införlivandet av EU:s rättsakter om konsumentskyddande bestämmelser i svensk rätt. Mer ingående kommer ångerrättens tillämpning i distansavtalslagen att utredas, med fokus på informationskravet och ångerfristen. Sedan tas det upp hur användandet av digitala tjänster och digitalt innehåll har påverkat utformningen av ångerättens undantagsbestämmelser, utifrån bestämmelser som 2 kap. 11 § 11 och 11 § 1 DAL. Med tanke på att det tidigare uppstått oreglerade rättsliga frågor i detta sammanhang och därav skapat utrymme för lagtolkning av olika rekvisit. En annan viktig aspekt är gränsdragningen mellan de två varianterna av avtal med digitala inslag samt ett fastställande av vilka rättigheter och skyldigheter som åligger både konsumenter och näringsidkare. - The Act on Distance Contracts and Off-Premises Contracts has undergone several changes to the law and developed in connection with the spread of digitalisation. This has led to increased use of digital services and goods with digital content. The design of the Distance Contracts Act's consumer protection provisions has also been influenced by modernized EU legislation, which was introduced with the aim of harmonizing the provisions for cross-border trade within the EU. - The Act on Distance Contracts and Off-Premises Contracts has undergone several changes to the law and developed in connection with the spread of digitalisation. This has led to increased use of digital services and goods with digital content. The design of the Distance Contracts Act's consumer protection provisions has also been influenced by modernized EU legislation, which was introduced with the aim of harmonizing the provisions for cross-border trade within the EU. The essay intends to give an account of the legal design of the Distance Contracts Act based on current law and the incorporation of EU legislation on consumer protection provisions into Swedish law. The application of the right of withdrawal in the Distance Contracts Act will be investigated in more detail, with a focus on the information requirement and the withdrawal period. Then it’s addressed how the use of digital services and digital content has affected the design of the exception provisions for the right of withdrawal, based on provisions such as ch. 2 11 § 11 and 11 § 1 DAL. Given that previously unregulated legal issues had arisen in this context and thereby created room for legal interpretation of various elements. Another important aspect is the delineation between the two variants of contracts with digital elements and a determination of which rights and obligations are imposed on both consumers and traders.
