Abstract (Swedish)
Syftet med examensarbetet är att redogöra för hur dagens lagar
kopplade till återbruk och offentlig upphandling tar hänsyn till införandet av cirkulär ekonomi i form av återbruk i upphandlingsskedet. Studien ska även utreda om det saknas lagstöd och i så fall vad som saknas för att återbrukat material ska kunna användas i större utsträckning än vad det gör idag. Arbetet ämnar även studera i vilken utsträckning som offentliga beställare arbetar med återbruk i dagsläget. Utöver det undersöker studien vilka hinder som kan uppstå för offentliga beställare i upphandlingsskedet.

Studien ska även utreda om det saknas lagstöd och i så fall vad som saknas för att återbrukat material ska kunna användas i större utsträckning än vad det gör idag. Arbetet ämnar även studera i vilken utsträckning som offentliga beställare arbetar med återbruk i dagsläget. Utöver det undersöker studien vilka hinder som kan uppstå för offentliga beställare i upphandlingsskedet.

I studien har en litteraturstudie samt en kvalitativ intervjustudie använts. Sex offentliga beställare i Blekinge och Skåne har varit delaktiga i intervjustudien. Respondenterna svarade bland annat på hur de arbetar med återbruk, om de ställer krav i upphandlingsskedet på återbruk och vad som behöver förbättras framöver.

Studiens resultat indikerar på att i stort sett samtliga respondenter arbetar med
återbruk, om än att det skiljer hur de arbetar med det. Inställningen bland respondenterna är god, däremot framkommer det att det finns många svårigheter och framförallt flera olika frågor som det saknas svar på. En stor utmaning med kravställning av återbruk är att tillgången på återbruk är mycket osäker vilket medför att det är svårt att formulera specifika krav på återbrukade produkter och material. Återbruksmarknaden är fortfarande liten och det råder större efterfrågan på återbruk än vad utbudet är. En annan stor utmaning är återbrukade produkter som saknar produktgarantier och vem som bär ansvaret. Dessutom råder det kunskapsbrist på många olika områden bland olika aktörer vilket är något som återspeglas i hela återbruksprocessen. För att kravställningar som rör återbruk framöver ska öka i upphandlingsskedet behövs med all största sannolikhet någon form av incitament. I det stora hela behöver också rutiner hos samtliga aktörer förändras och inte minst hos de offentliga beställarna. Det är viktigt att de inser att de har en viktig roll genom att de ställer tydliga och relevanta krav eftersom det i många fall lägger ribban för entreprenörernas arbete. (Less)

The purpose of the study is to investigate how current laws consider the introduction of a circular economy (CE) and reuse in the procurement stage. The study also aims to investigate what legal support is missing for reused materials to be used more than it does today. The work also aims to study the extent to which public clients currently work with reuse. In addition to that, the study investigates what obstacles may occur for public clients in the procurement phase.

The study also aims to investigate what legal support is missing for reused materials to be used more than it does today. The work also aims to study the extent to which public clients currently work with reuse. In addition to that, the study investigates what obstacles may occur for public clients in the procurement phase.

A literature study and a qualitative interview study have been used in the

The results of this study indicate that almost all respondents work with reused materials, although there is a difference in how they work with it. The attitude among the respondents is good, however it appears that there are many difficulties and above all several different questions for which there are no answers. A major challenge with setting requirements for reuse is that the availability of reused products and materials is very uncertain. This means that it is difficult to express specific requirements for reused products and materials. The reused market is still small and there is a greater demand for recycling than the supply. Another major challenge is the lack of guarantees for reused products and that is not clear who has the responsibility for these products. In addition, there is a lack of knowledge in many different areas among different actors, which is something that is reflected in the entire process. In order for requirements relating to reuse to increase in the procurement stage in the future, some form of incentive is most likely required. Especially, the routines of all actors also need to change, and not least for the public purchasers. It is important that they realize that they have an important role in expressing distinct and relevant demands because in many cases it sets the bar for the contractors' work. (Less)
