- I november 2023 presenterades en SOU som skulle se över hur sexköpslagen kan appliceras på onlineköp av sex. SOU:n kommer till följd av att nya former av sexköp, där även helt digitala former av sexköp, blivit vanligare. För andra bestämmelser i 6 kap. BrB förekommer redan en begreppsbildning som möjliggör lagföring vid sexualbrott utan fysisk kontakt mellan parterna.
Vid ny kriminalisering ska kriminaliseringsprinciper beaktas. I uppsatsen har principen om ultima ratio, principen om ett identifierat skyddsintresse, legalitetsprincipen och effektivitetsprincipen diskuterats. Alla fyra principer bidrar till att behålla rationalitet i straffrätten. Dock är principer inga absoluta regler varför de kan beaktas i större eller mindre... Det nya förslaget om onlineköp föreslår en begreppsbildning som utvidgar bestämmelsens tillämpningsområde. Redan innan förslaget har antagits finns det fog för kritik utifrån de fyra presenterade kriminaliseringsprinciperna. Andra åtgärder för att minska förekomsten av onlineköp av sex presenteras inte i utredningen. En diskussion om bestämmelsens skyddsintresse i förhållande till de nya formerna av sex mot ersättning online saknas också.
Vidare framstår gränsdragningen mellan sexköp och pornografi som svårnavigerad i den nya bestämmelsen. Detta, tillsammans med brottets natur som spaningsbrott, gör att bestämmelsen kan bli svårtillämpad. Det finns därför fog att ifrågasätta det nya förslaget utifrån etablerade kriminaliseringsprinciper. (Less) - Abstract

In other sections in ch. 6 the Criminal Code, concepts allow for prosecution of sex crimes without physical contact between the involved parties.
In case of new criminalization, criminalization principles must be considered. In the essay, the principles of ultima ratio, an identified protected interest, legality, and effectiveness have been discussed. All four principles contribute to maintaining rationality in criminal law. However, principles are not absolute rules and can be considered to greater or lesser extent.

The new proposal on online purchases of sex proposes a conceptualization which expands the provisions scope. Even before the proposal has been adopted, there is reason for criticism based on the criminalization principles. Other measures to reduce the occurrence of online purchases of sex are not presented in the SOU. A discussion on the provision's protective interest in relation to new forms of sex for compensation online is also missing.
Furthermore, the distinction between purchase of sex and pornography is difficult to navigate in the new provision. This, together with the nature of the crime, means the provision can be difficult to apply. There is therefore reason to question the new proposal based on established criminalization principles.
