- Abstract
- According to the legislative history of 1974 year’s Instrument of Government,
a statute must be drafted in a general form. The criteria on the generality of
law becomes prominent when the Riksdag seeks to enact a law to address a
concrete problem. In these cases, a tension arises between the sovereignty of
the people and the constitution.
This essay aims to further examine this tension. The purpose is to investigate
whether the Council on Legislation and the courts, invoking the criteria on
the generality of law, can limit the Riksdag’s legislative power. To achieve
this purpose, it is first examined what function the institutes have as reviewers

a statute must be drafted in a general form. The criteria on the generality of
law becomes prominent when the Riksdag seeks to enact a law to address a
concrete problem. In these cases, a tension arises between the sovereignty of
the people and the constitution.
This essay aims to further examine this tension. The purpose is to investigate
whether the Council on Legislation and the courts, invoking the criteria on
the generality of law, can limit the Riksdag’s legislative power. To achieve
this purpose, it is first examined what function the institutes have as reviewers
of the law, and what the criteria of the generality of law really stipulates.
Thereafter, a few concrete situations are analyzed where the Council on Legislation and the courts have applied the criteria on the generality of law in
relation to a (proposed) law.
For this essay, a legal dogmatic method with a critical and legal analytical
perspective was used. The material is mainly composed of legislative history
– including responses from the Council on Legislation – and precedents from
the Supreme Administrative Court.
The essay concludes that the Council on Legislation and the courts as institutes have limited possibilities to effectively challenge an unconstitutional
law. Additionally, there is an ambiguity surrounding the criteria on generality
of law. In summary, the present author observes that the Council on Legislation and the courts have a very limited possibility to restrict the Riksdag’s
legislative power by invoking the criteria on the generality of law. (Less) - Abstract (Swedish)

Uppsatsen har använt sig av en rättsdogmatisk metod med ett kritiskt och rättsanalytiskt perspektiv. Materialet består huvudsakligen av förarbeten – inbegripet lagrådsyttranden – och prejudikat från Högsta förvaltningsdomstolen.
Uppsatsen konkluderar att Lagrådet och domstolarna som institut har begränsad möjlighet att angripa en grundlagsstridig lag på ett effektivt sätt. Dessutom är generalitetskravets innebörd oklar. Sammantaget konstaterar förevarande författare att Lagrådet och domstolarna har mycket begränsade möjligheter att med åberopande av generalitetskravet begränsa riksdagens lagstiftningsmakt. (Less)
