Hedersmotiv vid dödligt våld – Rättsväsendets uppfattning och bedömning av mord som begås i hederns namn

Den som har ådragit kollektivet skam måste dö. Inom hederskulturen är bevarandet av äran det viktigaste som existerar. Sedan millennieskiftet har ett tiotal hedersmord uppmärksammats i Sverige och trots alla de som kämpat och kämpar emot det hedersrelaterade våldet och förtrycket så förekommer det i stor utsträckning än idag.

Domstolen har 1 juli 2020 haft möjlighet att tillämpa en ny straffskärpningsgrund i straffmätningen då motivet för brottet har varit att bevara eller återupprätta en familjs heder. Sedan millennieskiftet har ett tiotal hedersmord uppmärksammats i Sverige och trots alla de som kämpat och kämpar emot det hedersrelaterade våldet och förtrycket så förekommer det i stor utsträckning än idag.

Domstolen har 1 juli 2020 haft möjlighet att tillämpa en ny straffskärpningsgrund i straffmätningen då motivet för brottet har varit att bevara eller återupprätta en familjs heder. Hedersmotivet har diskuterats i domskäl även innan bestämmelsen trädde i kraft men har nu fått större och tydligare utrymme. Däremot finns fortfarande frågetecken kring när hedersmotiv föreligger vid dödligt våld och inte – till och med underinstanserna emellan. Frågan är då hur hedersmotiven ska identifieras och vilka gemensamma attribut som kan urskiljas. För att den nya bestämmelsen ska få bäring och kunna ge upprättelse åt offren krävs att rättsväsendet har en enad bild och förståelse för hur heders-kulturen tar sig uttryck, annars kan de utsatta inte få den hjälp de har rätt till och förtjänar.

Syftet med uppsatsen är således att identifiera gemensamma attribut vid hedersmord och analysera hur domstolen bedömer och uppfattar hederskulturens karaktäristiska drag i relation till hedersfenomenet i sin helhet. Detta för att belysa problematiken och rädda utsatta från framtida hänsynslösa och grymma brott begångna av sina närstående förövare.

Uppsatsen kommer fram till att domstolen bör beakta ytterligare omständigheter som kännetecknar hedersmord i sin bedömning av hedersmotivet. I stället för att fokusera på gärningsmannens utsaga måste ses till helheten. Däribland det dödliga våldets utövande och även de mer passiva valen gärningsmannen gör i samband med brottet. Det är i de mindre detaljerna som motivet avslöjas, därav får de inte försummas av domstolen. (Less)
Abstract
The one who has incurred disgrace upon the community must die. To pre-serve glory is what matters the most within the culture of honour. Since the turn of the millennium there have been about ten noted honour killings in Sweden, and despite everyone who has fought and are fighting against honour-related violence and oppression it still largely occurs to this day.

Since July 1st, 2020, the court has been able to apply a new provision for increasing punishment when the motive for the criminal act has been to preserve or restore the honour of the family. The honour motive has been discussed in reasoning prior to the new regulation entering into force but has now gained space and recognition. Although, there are still some question marks... (More)
The one who has incurred disgrace upon the community must die. To pre-serve glory is what matters the most within the culture of honour. Since the turn of the millennium there have been about ten noted honour killings in Sweden, and despite everyone who has fought and are fighting against honour-related violence and oppression it still largely occurs to this day.

Since July 1st, 2020, the court has been able to apply a new provision for increasing punishment when the motive for the criminal act has been to preserve or restore the honour of the family. The honour motive has been discussed in reasoning prior to the new regulation entering into force but has now gained space and recognition. Although, there are still some question marks regarding when an honour motive exists or not – even in-between the lower instances. The question is how the honour motive should be identified and which joint attributes that can be distinguished. The judicial system must obtain a united picture and understanding of how the culture of honour takes place for the new regulation to gain bearing and contribute to the victim’s rectification, otherwise there is a risk that the exposed persons won’t get the help they deserve and need.

Thus, the purpose of this essay is to identify common attributes regarding honour killings and to analyze how the court judges and perceives characteristics of the culture of honour in relation to the phenomenon itself to illustrate its difficulties and save the vulnerable persons from future reckless and cruel crimes committed by their close relatives.

The essay reaches the conclusion that the court should consider further circumstances that characterizes honour killings when assessing the honour motive. They must attend to the entirety instead of mostly focusing on the perpetrators statement. For example, the exertion of the lethal violence and the more passive choices the offender makes in conjunction with the criminal act. The motive gets revealed by observing the smaller details, therefore they cannot be neglected by the court. (Less)
