- An individual who is, on probable grounds, suspected of a crime with a
prescribed penalty of imprisonment for one year, may be deprived of its
liberty by detention if the prerequisites is met. Detention is a criminal
procedure coercive measure used by prosecutors and courts to expedite the
pre-trial investigation and to ensure both prosecution as well as the execution
of the penalty. Detention is a direct and continuing coercion measure, which
results in an intervention with the individual’s constitutional freedom and
rights during the period of the deprivation of liberty.

In connection with the increasing crime rate in Sweden, detention has become
an increasingly common measure in the fight against crime. It is undisputed
that detention can be a necessary measure, but in practice there have been
indications that its scope of application has expanded. Against this
background, the essay’s purpose is to examine how and why the Swedish
detention system, with particular focus on ch. 24 § 1 RB, has changed since
its introduction. It is important to investigate whether detention serves its
original purpose or whether there has been a shift in the law that creates an
imbalance between, on one hand, society’s need to fight crime, and on other
hand, the general principles of criminal coercive measures that must be
satisfied when using detention.
To answer this question, preliminary work and legislation have been analyzed
from its introduction to the current law. With a theoretical perspective that
considers the human dignity, the presumption of innocence and the rule of
law, the analysis shows a shift in the current law in certain aspects. The
purpose of detention has become increasingly broad – from a criminal
coercive measure to a crime prevention tool, which contradicts the
fundamental idea behind the function of procedural coercive measures. This
shift tends to enable the overuse of detention. Furthermore, the overuse of
detention risks individuals being detained routinely, which, given its intrusive
nature and in the light of the general principles of criminal coercive measures,
cannot be considered acceptable in a democratic rule of law such as Sweden. (Less) - Abstract (Swedish)

särskilda rekvisiten är uppfyllda. Häktning är ett straffprocessuellt tvångsmedel som används av åklagare och domstol i syfte att effektivisera förundersökningen samt säkerställa såväl lagföring som verkställighet av

syfte att undersöka hur och varför det svenska häktningsinstitutet, med särskilt fokus på 24 kap. 1 § RB, har förändrats sedan dess införande. Det är
viktigt att undersöka om häktning tjänar sitt ursprungliga ändamål eller om det har skett en förskjutning av gällande rätt som kan skapa obalans mellan å ena sidan samhällets behov av att bekämpa brott, å andra sidan de allmänna straffprocessuella principer som ska tillgodoses vid användandet av häktning.
För att besvara frågeställningen har förarbeten och lagstiftning analyserats från dess införande till nu gällande rätt. Med ett teoretiskt perspektiv som
beaktar individens människovärde, oskyldighetspresumtionen och rättssäkerheten, visar analysen en förskjutning av gällande rätt i vissa delar.
Häktningens syfte har blivit alltmer vidsträckt – från ett straffprocessuellt tvångsmedel till ett allmänpreventivt verktyg, vilket strider mot den
grundläggande tanken bakom straffprocessuella tvångsmedels funktion. Förskjutningen tenderar att möjliggöra en överanvändning av häktning som
tvångsmedel. En överanvändning av häktning som tvångsmedel riskerar att individer frihetsberövas slentrianmässigt, vilket mot bakgrund av dess
ingripande karaktär och de allmänna straffprocessuella principerna, inte kan anses godtagbart i en demokratisk rättsstat som Sverige. (Less)
