Barnets bästa, en eller fler principer? En analys av hur barnets bästa tillämpas i utvisningsärenden respektive LVU-ärenden

Barnets bästa är en central princip som har sin grund i barnkonventionen. Be- stämmelsen är intagen i såväl UtlL som LVU men dock med skilda formule- ringar. Barnets bästa ska beaktas och väga tungt i utvisningsärenden men vara avgörande i LVU-ärenden. Uppsatsens syftar till att beskriva vad principen barnets bästa innebär enligt gällande rätt, men också genom en empirisk undersökning av såväl LVU-ärenden som utvisningsärenden undersöka om och i sådana fall hur bedömningarna skiljer sig åt mellan respektive område.

Me- dan barnets bästa framförallt bedöms utifrån riskfaktorer och bristande för- äldraförmåga i LVU-ärendena utgår beslutsfattarna huvudsakligen från bar- nets anknytning och anpassning till Sverige i utvisningsärendena. Skillna- derna i bedömningarna skulle kunna förklaras av varierande synsätt på bar- nets bästa samt de olika syftena och utformningarna av lagstiftningen inom respektive område. (Less)

The best interest of the child should be considered and carry significant weight in deportation cases but be decisive in LVU cases. The aim of the essay is to describe what the principle of the best interest of the child entails according to current law. Through an empirical investigation of both LVU and deportation cases, the essay seeks to explore if and how the assessments differ between the respective areas.

Through an empirical investigation of both LVU and deportation cases, the essay seeks to explore if and how the assessments differ between the respective areas.
The analysis of legal cases suggests a lack of comprehensive assessments within each respective area and differences in assessments between these ar- eas. While the best interest of the child is primarily evaluated based on risk factors and insufficient parental capabilities in LVU cases, decision-makers predominantly consider the child's attachment and adaptation to Sweden in deportation cases. The variations in assessments could be explained by dif- fering perspectives on the best interest of the child as well as the distinct pur- poses and designs of legislation within each area. (Less)
