Omskärelse av barn - samma men olika? - En jämförelse av regleringarna avseende omskärelse av flickor och pojkar

Abstract (Swedish)
Denna uppsats syftar till att rikta uppmärksamhet mot svensk reglering av genitala ingrepp på minderåriga, mer specifikt lagen (2001:499) om omskärelse av pojkar och lagen (1982:316) med förbud mot könsstympning av kvinnor. Som framgår redan här finns två olika regleringar att tillämpa, beroende på vilket fysiskt könsorgan ingreppet riktas mot. I uppsatsen granskas dessa två regleringar. Fokus är särskilt att analysera förarbeten till lagarna för att söka utröna lagstiftarens bild av respektive grupp av ingrepp. Med en sådan analys kan insikter om lagstiftarens val av styrning (reglering) erhållas och eventuell kritik mot detta kan framföras.

Resultatet i denna uppsats visar bland annat att nuvarande reglering bygger på lagstiftarens uppfattning om omskärelse av flickor som en specifik typ av ingrepp respektive omskärelse av pojkar som en annan specifik typ av ingrepp. Med lagstiftarens uppfattning i åtanke kan regleringarna framstå som rimliga men vid tillämpning av bland annat ett barnrättsligt perspektiv framstår regleringarna som otillfredsställande, då barnen tillförsäkras ett ojämnt skydd mot ingreppen. Abstract
The purpose of this paper is to draw attention to Swedish regulations regarding genital interventions on minors, more specifically the law on circumcision of boys (2001:499) and the law prohibiting female genital mutilation (1982:316). As indicated by this statement alone, there are two different regulations to apply in regards to genital procedures, depending on the external genitalia of the child which the intervention is directed at. The essay examines these two regulations with particular focus on analyzing the policies and preparatory work that substantiate the laws under examination. The purpose of this paper is to draw attention to Swedish regulations regarding genital interventions on minors, more specifically the law on circumcision of boys (2001:499) and the law prohibiting female genital mutilation (1982:316). As indicated by this statement alone, there are two different regulations to apply in regards to genital procedures, depending on the external genitalia of the child which the intervention is directed at. The essay examines these two regulations with particular focus on analyzing the policies and preparatory work that substantiate the laws under examination. The aim is to uncover the legislator’s perception of the genital interventions discussed. This analysis may provide insights with respect to the legislator’s way of governing the procedures, which facilitates an opportonity to dispute the perception of the interventions as well as the way of governing these.

The result of this paper suggest that, among other things, the current regulation of genital procedures on minors is based upon an idea that frames circumcision of girls as one distinct type of genital procedure and circumcision of boys as another distinct type of genital procedure. Viewing the regulations with this perception in mind, they appear as reasonable techniques for governance. However, in applying a perspective that places the children’s rights in the foreground, the regulations appear unsatisfactory as the children are ensured unequal protection when subjected to one of the genital procedures in question.
