- På senare år har det skett en bred förskjutning i synen på barn- och föräldrarätt. Ett starkare barnrättsperspektiv har etablerats inom svensk rätt och politik. Flera ändringar har gjorts i föräldrabalken. En av dessa ändringar återfinns i 6 kap. 19 § tredje stycket föräldrabalken. I proposition 2020/21:150 föreslog den dåvarande regeringen en lagstadgad tidsgräns på fyra månader när det kommer till utredningar i mål om vårdnad, boende och umgänge. Denna lagändring trädde sedermera i kraft den 1 juli 2021.

Det primära syftet med uppsatsen är att utreda vilka effekter tidsinskränkningen i 6 kap. 19 § tredje stycket föräldrabalken har haft i praktiken. Initialt syftar utredningen till att klargöra om tidsinskränkningen har påverkat utredarnas arbete och i förlängningen hur det i så fall har påverkat beslutsunderlaget för domstolarna. Min tes är att kortare tid påverkar utredningarnas kvalitet menligt, vilket innebär ett sämre beslutsunderlag för domstolarna. Ett sämre beslutsunderlag för domstolarna påverkar i sin tur fastställandet av barnets bästa.
Som ett komplement till den traditionella rättsdogmatiska metoden har den rättsanalytiska metoden använts. Därutöver har en empirisk metod använts för att belysa verkligheten på ett vetenskapligt plan. Med hjälp av den empiriska metoden har intervjuer genomförts med familjerättsliga utredare som arbetar inom olika kommuner i Skåne.
Slutsatserna som har kunnat dras av uppsatsens syften och frågeställningar är följande. En utredning i mål om vårdnad, boende och umgängen är ett mycket viktigt underlag för domstolens beslut och den måste därför alltid vara av hög kvalitet och ha ett tydligt barnperspektiv. Lagstiftarens syfte med ändringen var att bidra till en mer effektiv handläggning av vårdnadsmål. Lagstiftarens ambition var att handläggningstiderna skulle kunna kortas ned, utan att utredningarnas kvalitet skulle påverkas negativt. Efter att ha intervjuat sex familjerättssekreterare från olika kommuner i Skåne kan följande konstateras. Familjerättssekreterarnas upplevelser varierar beroende på vilken kommun de arbetar inom. Familjerättssekreterarna är dock överens om att lagändringen inte har påverkat deras arbete på något negativt sätt. Den stora förändringen verkar vara att domstolen har skärpt kraven på begäran om anstånd. Det finns en önskan från vissa praktiker om att även domstolen borde föreläggas att sätta ut ett mål till huvudförhandling inom en viss tidsgräns. (Less) - Abstract

The primary purpose of this essay is to investigate what effects the time limitation in Chapter 6, Section 19, third paragraph of the Children and Parents Code has had in practice. Initially, the investigation aims to clarify whether the time limitation has affected the investigators’ work and, by extension, how it has affected the decision-making basis for the courts. My thesis is that shorter investigation times affect the quality of the investigations, which means a worse basis for the courts. A worse decision-making basis for the courts affects the determination of the child’s best interests.
As a complement to the traditional legal dogmatic method, the legal analytical method has been used. In addition, an empirical method has been used to shed light on reality at a scientific level. With the help of the empirical method, interviews have been conducted with social workers who work within different municipalities in Skåne.
The conclusions that have been drawn from the essay’s aims and questions are as follows. An investigation in custody, accommodation, and contact cases is a very important basis for the court’s decision and must, therefore, always be of high quality and have a clear children’s perspective. The legislator’s purpose for the amendment was to contribute to a more efficient procedure for custody cases. The legislator’s ambition was that the processing times could be shortened without the quality of the investigations being negatively affected. After interviewing six social workers from various municipalities in Skåne, the following can be stated: The social workers’ experiences vary depending on which municipality they work in. However, the social workers agree that the amendment has not affected their work in any negative way. The big change seems to be that the court has tightened the requirements for requests for deferment. Some practitioners desire that the court should also be required to set a case for a main hearing within a certain time limit. (Less)
