- Abstract
- The study aimed to investigate gender differences in court decisions about compulsory care according to LVM through a gender perspective. Normative notions about women and men exist and are reproduced throughout society. These normative notions can be found within the judiciary and social services, which affects the professional's assessment regarding addicted men and women in court orders concerning compulsory care. Varying assessments depending on gender are problematic because coercive legislation restricts the individual's freedom. To acknowledge the gender-based differences in the court orders a qualitative critical discourse analysis will be used to reveal the gender constructions. The study is based on an analysis of 60 court orders... (More)

Varying assessments depending on gender are problematic because coercive legislation restricts the individual's freedom. To acknowledge the gender-based differences in the court orders a qualitative critical discourse analysis will be used to reveal the gender constructions. The study is based on an analysis of 60 court orders regarding the Swedish compulsory care law LVM, with an equal division of 30 men and 30 women. The court orders were analyzed through gender theory, by using Hirdman and Butler's theoretical concepts. The study concluded that normative notions about men and women were found throughout the court orders. For women, their addiction was portrayed more seriously through the use of strong words in the description of the women’s current situation and the consequences the addiction could bring. In regards to both the women’s and men’s addiction, the court expressed descriptions by gender norms, such as the man being strong, unsentimental, and independent while the woman being the opposite.
