- Abstract
- At a time when artificial intelligence is developing rapidly, this thesis explores the issue of copyright infringement of AI-generated artworks. This study aims to analyze the legal complexities brought about by the increasingly widespread application of artificial intelligence in the creation of original artworks, with a special focus on the protection of creators’ rights and intellectual property rights. This study aims to analyze the legal complexities brought about by the increasingly widespread application of artificial intelligence in the creation of original artworks, with a special focus on the protection of creators’ rights and intellectual property rights. Through an in-depth analysis of relevant cases and legislation in the United States and the European Union, combined with the concept of reproduction rights and exceptions and limitations to copyright, this thesis explores the impact of AI-generated works and technologies such as machine learning on the exclusive rights of rightholders. Many issues regarding generative AI and copyright are still unclear in judicial practice, but machine learning may indeed infringe on the right of reproduction.
