Abstract
The purpose of the essay was to identify, illuminate, and analyze discourses about children's rights and to show, from a childhood sociological perspective, how children's position was made visible in the preparatory works, which led to the new act SFS 2024:79. The selection of texts has included relevant documents related to the preparatory works and legislative history. By combining critical discourse analysis with childhood sociology, we have shown how discourses about children's rights, protection, and participation as well as parents' rights and legal rights are constructed and reproduced in legislation. The purpose of the essay was to identify, illuminate, and analyze discourses about children's rights and to show, from a childhood sociological perspective, how children's position was made visible in the preparatory works, which led to the new act SFS 2024:79. The selection of texts has included relevant documents related to the preparatory works and legislative history. By combining critical discourse analysis with childhood sociology, we have shown how discourses about children's rights, protection, and participation as well as parents' rights and legal rights are constructed and reproduced in legislation. The results showed that children are portrayed as bearers of their rights with the right to participate. Despite this, the child's participation remained dependent on adults' judgment of what is in the child's best interest, which showed the dilemma between protecting children from violence and safeguarding their rights. The result indicated that a shift has taken place in the laws enacted by the legislative body, from the guardian's strong position to the authorities' responsibility and power to intervene in the best interests of the child.
