This thesis explores the relationship between French restrictive policies on the hijab and burqa and their impact on the human rights and fundamental freedoms of Muslim women. It likely delves into the historical context of these policies, analyses the legality and implications of such restrictions, and considers the broader sociocultural and political factors at play. It further examines the intersection of religious expression, gender equality, and individual autonomy within this complex issue. Ultimately, it aims to pro-vide insights into how these policies affect the lives of Muslim women in France and address the broader implications for human rights and freedoms in a multicultural society.

International human rights law (hereafter referred to as IHRL) enshrines the right to freedom of religion and belief as a fundamental human right. Limitations on religious attire such as the hijab and burqa can potentially in-fringe upon this right, highlighting the need to examine how such re-strictions align with international legal standards. The intersection of religious practices and gender equality is a complex issue that requires careful consideration within the realm of human rights law. Understanding how policies on religious attire impact women's rights is crucial for promoting gender equality within diverse societies. IHRL emphasizes the importance of respecting cultural diversity and individual freedoms. Restrictions on religious attire can raise questions about tolerance, diversity, and cultural acceptance, making it vital to assess their compatibility with human rights principles. IHRL prohibits discrimination on various grounds, including religion and gender. By examining the impact of policies targeting specific religious practices, such as the hijab and burqa, on Muslim women, one can assess whether these restrictions uphold the principle of non-discrimination as enshrined in international instruments. Given the broader implications of religious freedom and women's rights worldwide, studying this topic in the context of International human rights law can contribute to global discussions on how to balance competing rights, foster inclusive societies, and uphold human dignity for all individuals. By delving into these complex issues, this thesis provides valuable insights for policymakers, legal practitioners, advocates, and scholars working in the field of International human rights law.

This study provides a comprehensive legal analysis of the compatibility of French policies with international human rights law, highlighting any in-consistencies or violations of key human rights principles such as freedom of religion, non-discrimination, and gender equality. By examining the lived experiences and perspectives of Muslim women affected by these policies, the study can shed light on the practical implications of re-strictions on religious attire, including social, cultural, and psychological impacts.

Based on the findings, the study proposes targeted policy recommendations to address any human rights shortcomings or challenges identified, aiming to promote greater respect for individual freedoms, cultural diversity, and gender equality within the legal framework. Understanding the social and cultural dynamics surrounding the debate on hijab and burqa restrictions in France can provide valuable insights into broader issues of identity, integration, and multiculturalism, contributing to more nuanced discussions on these complex topics. The study's findings and analysis could enrich aca-demic literature on human rights, religious freedom, gender equality, and multiculturalism, offering new perspectives, research methodologies, and theoretical frameworks for scholars and researchers in related fields. By raising awareness about the intersection of religious practices, women's rights, and human rights law, the study may support advocacy efforts aimed at safeguarding fundamental freedoms, challenging discriminatory practices, and fostering inclusive societies.
Overall, the results of this study have the potential to inform policy de-bates, influence legal reforms, empower marginalized communities, and advance the protection of human rights and fundamental freedoms in the context of diverse, multicultural societies. (Less)
