Abstract
Since the incorporation of the UN Convention on the Rights of the Child into Swedish legislation on January 1, 2020, the topic of children’s rights and the best interests of the child has gained increased prominence within social services – not least within the context of financial assistance. We have conducted interviews with eight social workers in a Swedish municipality to examine how work related to children’s rights, the child's perspective and the best interests of the child is carried out within financial assistance services. Since the incorporation of the UN Convention on the Rights of the Child into Swedish legislation on January 1, 2020, the topic of children’s rights and the best interests of the child has gained increased prominence within social services – not least within the context of financial assistance. We have conducted interviews with eight social workers in a Swedish municipality to examine how work related to children’s rights, the child's perspective and the best interests of the child is carried out within financial assistance services. Our theoretical framework is based on Lipsky’s theory of street-level bureaucrats, along with new institutional theory regarding rationalized myths, conflicting institutional logics, and organizational inertia. Our findings reveal a discrepancy between the stated approach and extent of working with children’s rights and the actual practices in place. The methods and practices introduced to consider the best interests of the child are, due to varying factors, rarely applied correctly or sufficiently. Furthermore, our results indicate that legal and organizational conditions create and sustain the institutionalized notion of acceptable suffering regarding children. Finally, we discuss whether the fundamental purpose of financial assistance should indeed be to prioritize the best interests of the child, and if so, why the necessary means to achieve this are not provided.
