Criminal networks in Sweden and children’s right to protection from violence

Abstract
This thesis examines the ongoing violent situation with the criminal networks in Sweden, what the obligations under article 19 of the UN Convention on the Rights of the Child entail and to what extent the measures taken by the Swedish government live up to these obligations. Many children today are in various ways being affected by the gang-related violence, especially those who live in the vulnerable neighbourhoods. I found this topic important to investigate further, with the hope that the overall approach to this major issue could be based on the rights of the child instead of mainly looking at this as a matter of criminal politics.

This thesis examines the ongoing violent situation with the criminal networks in Sweden, what the obligations under article 19 of the UN Convention on the Rights of the Child entail and to what extent the measures taken by the Swedish government live up to these obligations. Many children today are in various ways being affected by the gang-related violence, especially those who live in the vulnerable neighbourhoods. I found this topic important to investigate further, with the hope that the overall approach to this major issue could be based on the rights of the child instead of mainly looking at this as a matter of criminal politics.

The criminal networks in Sweden consist of mostly boys and young men, and they are recruiting children as young as 12 years old. The children are experiencing many different forms of violence within and from the criminal networks, all from risking to be shot to witnessing others being violently punished or killed. The networks capacity of violence is getting larger every year, and more and more children are being involved with the criminal networks or harmed because of their violence. There is a wide-ranging obligation for state parties to the Convention on the Rights of the Child to protect children from all forms of violence. This obligation mainly entails to take preventive measures and they shall for instance be educational, legislative, social and administrative. They also need to entail effective procedures and be appropriate. The Swedish Government has taken many measures recently in their fight against the criminal networks. Most of them have been legislative focusing on getting a rather quick end to the gang related violence, but also some measures are more long-term and more in line with the obligations under article 19.

The main conclusion from my research is that the Swedish Government is starting to approach this problem with solutions that hopefully are more long-term and hence preventive. However, do I find the situation and the many criminal law responses and legislative measures quite worrying, seen from the affected children’s perspective. I do believe there might be measures presented or adopted that will be much more preventive and protecting children from all form of violence to a larger extent than today. The main problem is that these results are many years away, and it might be hard to overview the effects of all measures since so many have been adopted on the same topic during a quite short period of time.
