- Svenska hushåll är bland de mest skuldsatta i EU. Överskuldsättning kopplas till förödande konsekvenser för människors liv och livskvalitet. Den överskuldsättning vissa konsumenter hamnar i gör att frågan om hur krediterna blivit godkända är nära till hands, särskilt med hänsyn till kreditprövning och kraven som ställs på denna i konsumentkreditlagen.
Kreditprövning är till sin natur en preventiv åtgärd från lagstiftaren. Lagstiftaren önskar genom kreditprövning att motverka överskuldsättning genom att de riskfyllda skulderna aldrig blir skapta. Själva skapandet av en konsumentkredit påbjuder olika komplexa frågeställningar om ansvar och ansvarsfördelning inom den svenska och EU-rättsliga lagstiftningen.

Uppsatsen konstaterar att kreditprövningar är en effektiv åtgärd som inte ges tillfälle i praktiken att få den konsumentskyddande effekt den har som ändamål. Stora delar av kritiken som förs i uppsatsen är mot kreditprövningsbegreppets vaghet.
Den nuvarande kreditprövningen diskuteras i uppsatsen i relation till vigilansprincipen inom förmögenhetsrätten. Vigilansprincipen är oskäligt tungt placerad på konsumenten i konsumentkreditförhållanden. Uppsatsen konstaterar att kreditprövningen som sådan till stor del är ineffektivt reglerad eller inte konkret detaljreglerad alls. Den rådande otydligheten i vad kreditprövningen innefattar utnyttjas av kreditgivare och det tilltänkta konsumentskyddet i den svenska nationella lagstiftningen urholkas. (Less) - Abstract

The state of the overindebtedness affecting some consumers begs the question how the loans were ever approved in the first place, having undergone credit assessment in accordance with consumer credit regulation.
Credit assessment is in its nature a preventive measure taken by the legislator. The legislator wishes through the regulation concerning credit assessment to combat overindebtedness and risky debt before the problems are ever created. The entrance into consumer debt raises a number of complex concerns about responsibility, blame and duty within... (More) - Swedish households have among the highest rates of debt in the EU. Credit assessment is in its nature a preventive measure taken by the legislator. The legislator wishes through the regulation concerning credit assessment to combat overindebtedness and risky debt before the problems are ever created. The entrance into consumer debt raises a number of complex concerns about responsibility, blame and duty within both Swedish and EU-regulation.
This essay contends that credit assessment is a preferable way of regulation due to its preventive nature, however credit assessment is not in its current form given the chance to achieve the goals and aims intended with the regulation. The criticism in this essay mostly concerns the vagueness of the legal concept of credit assessment.
The current credit assessment is discussed in this essay in relation to the contractual principle of vigilance. The burden of being vigilant is placed in an unduly heavy manner on the consumer. This essay states that credit assessment as such is to a great extent an ineffectively regulated measure, having little to no regulations concerning the concrete details of what a proper credit assessment constitutes. The current ambiguity in what a proper credit assessment entails is being used by creditors and this is allowing the explicit aim of consumer protection within the current sources of law to be undermined.
