- Genom en analys av rättspraxis visar studien på skillnad i hur domstolar bedömer straffansvaret. Kravet på kunskap eller medvetenhet om prostitutionen har visat sig vara centralt för att fastställa straffrättsligt ansvar, men tolkningen av vad som utgör ett främjande varierar mellan olika fall. Till exempel anser vissa domar att det är tillräckligt att medvetet bidra till en partners prostitution, medan andra betonar att förövaren måste spela en mer aktiv roll för att ansvar ska uppstå. Vidare skiljer sig domstolarna åt i sina beviskrav, särskilt när det gäller om medel som tillförts ett gemensamt hushåll med säkerhet kan kopplas till prostitution.

I uppsatsen dras slutsatsen att även om lagstiftningen generellt sett är adekvat riskerar dess breda tolkningsutrymme att urholka rättssäkerheten, särskilt i avsaknad av tydliga prejudikat för dessa specifika scenarion. Det understryks att det behövs ett större klargörande av frågor som barnomsorg och andra rutinmässiga åtgärder inom samboförhållanden, samt ett mer konsekvent tillvägagångssätt för att förstå gränsen för straffansvar. - This paper examines the criminal liability for procuration under Swedish law, with a particular focus on cases where prostitution occurs within cohabitation or marriage. With the help of a legal-dogmatic method, current law and legal practice are analysed. This paper highlights the legal challenges that arise when everyday activities within close relationships - such as childcare or household chores - potentially can be interpreted as criminal acts, depending on the context.
By analysing case law, the study shows differences in how courts assess criminal liability. The requirement of knowledge or awareness of prostitution has been found to be central to establishing criminal liability, but the interpretation of what constitutes promotion... (More) - This paper examines the criminal liability for procuration under Swedish law, with a particular focus on cases where prostitution occurs within cohabitation or marriage. With the help of a legal-dogmatic method, current law and legal practice are analysed. This paper highlights the legal challenges that arise when everyday activities within close relationships - such as childcare or household chores - potentially can be interpreted as criminal acts, depending on the context.
By analysing case law, the study shows differences in how courts assess criminal liability. The requirement of knowledge or awareness of prostitution has been found to be central to establishing criminal liability, but the interpretation of what constitutes promotion varies from case to case. For example, some judgments consider it sufficient to knowingly contribute to a partner's prostitution, while others emphasise that the perpetrator must play a more active role for liability to arise. Furthermore, courts differ in their evidentiary requirements, in particular as regards whether funds brought into a joint household can be reliably linked to prostitution.
The paper concludes that while the legislation is generally adequate, its broad scope of interpretation risks undermining legal certainty, especially in the absence of clear precedents for these specific scenarios. It emphasises the need for greater clarification on issues such as childcare and other routine actions within cohabitation relationships, as well as a more consistent approach to understanding the limits of criminal liability.
