Abstrakt och konkret förvaltning: en undersökning av sekretessbrytande bestämmelser inom personlig assistans

I uppsatsen utreds vad som förutsätts för ett fungerande informationsutbyte mellan myndigheter. Utifrån svaret på det undersöks huruvida befintliga sekretessbrytande bestämmelser är tillräckliga eller om förslaget om en ny sekretessbrytande bestämmelse behövs såsom den presenteras i det första delbetänkandet för ett förbättrat informationsutbyte som meddelades i september 2024.

Undersökningen visar att ett fungerande informationsutbyte förutsätter att personlig integritet, som är utgångspunkten för regleringen, bryts ned så att man kan skilja på abstrakta och konkreta intrång. Det är genom att göra detta som informationsutbyte kan innefatta mer än endast ett intresse, vilket är väsentligt utifrån rättsstatliga värden.

The purpose of this thesis is to investigate what aspects that are significant to achieve a well exchange of information between authorities. Based on that answer the paper analyses whether existing articles that permit an exchange of information despite confidentiality are sufficient, or if there is need of an additional article such as the one that has been suggested in an interim report for an improved exchange of information between authorities.

The investigation tells that a sufficient exchange of information between authorities requires that personal integrity, as the basis of the regulation, needs to as a concept be fragmentised in a way so that one can distinguish abstract and specific violations of it. By doing so the exchange of information may comprehend more than one value, something that is necessary in accordance with the principles of the rule of law.

Bearing in mind the above said, the existing articles that permit exchange of information despite confidentiality are sufficient when compared to the article that has been suggested in the interim report. With that said, there are aspects with existing regulation that need to be improved, and it remains to see how the political and legal situation develops. (Less)
